This chapter shall be known and may be cited as the "Frazer Township Subdivision and Land Development Ordinance."

This chapter is adopted in accordance with and pursuant to the authority granted to Frazer Township to regulate subdivisions and land developments by the Pennsylvania Municipalities Planning Code, 53 P.S. § 10101 et seq., as amended and reenacted.

1. 
This chapter is adopted for the following purposes:
A. 
To promote and protect the public health, safety, morals and welfare.
B. 
To promote orderly, efficient, integrated and harmonious development in the Township.
C. 
To require sites suitable for building purposes and human habitation in keeping with the standards of quality existing in the Township and to alleviate peril from fire, flood, erosion, excessive noise, smoke and other menace.
D. 
To coordinate proposed streets and other improvements with existing or proposed streets, parks or other features of the comprehensive plan and to provide for drainage, water supply, sewage disposal and other appropriate utility services.
E. 
To encourage preservation of adequate open spaces for recreation, light and air and maintenance of the natural amenities and characteristics of the Township and its agricultural, residential, commercial, industrial and public areas.
F. 
To ensure conformance of subdivision and land development plans with the Comprehensive Plan, Zoning Ordinance [Chapter 27] and Township public improvement plans and to ensure coordination of intergovernmental improvement plans and programs.
G. 
To secure equitable treatment of all subdivision and land development plans by providing uniform procedures and standards.
H. 
To ensure that developments are environmentally sound by requiring preservation of the natural features in the areas to be developed to the greatest extent practicable, to maintain the economic well-being of the Township and to prevent overcrowding of land, blight, runoff, pollution, danger and congestion in travel and transportation, and loss of health, life or property from fire, peril or other dangers.
I. 
To secure the protection of water resources and drainageways.
J. 
To establish provisions governing the standards by which streets shall be granted and improved, and walkways, curbs, gutters, street lights, fire hydrants, water and sewage facilities, and other improvements shall be installed as a condition precedent to final approval of plans.
2. 
This chapter is promulgated in accordance with and in furtherance of the community development objectives set forth in the Township Comprehensive Plan and the Zoning Ordinance [Chapter 27].

A subdivision plan, consolidation plan or land development plan approved in accordance with this chapter shall be required for:
A. 
Any land development, as defined by this chapter.
B. 
Any subdivision, as defined by this chapter.
C. 
Any development in which the developer and/or landowner proposes or intends to construct streets or any other public improvement to be dedicated to the Township for public use.

1. 
No land development or subdivision of any lot, tract or parcel of land shall be made or approved, no lot in a subdivision shall be sold, no permit to grade, erect, alter, repair or occupy any land, building or structure shall be issued, no building or structure shall be erected, and no street, sanitary sewer, storm sewer, water main or other improvements in connection therewith shall be laid out, constructed, opened or dedicated for public use or travel, or for the common use of occupants of buildings abutting thereon, except in accordance with the provisions of this chapter and all other provisions of the Frazer Township Code of Ordinances and other Township ordinances, resolutions and regulations, and all other applicable Federal, State, County laws, statutes, ordinances, resolutions and regulations.
2. 
No grading, earth disturbance, construction or site development activity shall be undertaken, nor shall any grading, building, occupancy or other permit be issued until an applicant shall apply for, obtain and comply with all necessary Federal, State, County and Township permits and approvals, including, but not limited to, any highway occupancy permits and traffic signal permits required by the Township under Chapter 21 of the Frazer Township Code of Ordinances, Streets and Sidewalks, as amended, Allegheny County under its applicable regulations, and PennDOT under the State Highway Law, 63 P.S. § 67-420, as amended, PennDOT's regulations or otherwise.
3. 
Real estate transfer documents or other documents used for selling or transferring property cannot by themselves effectuate a subdivision or land development of property unless the seller or transferor first complies with the requirements of this chapter and all other provisions of the Frazer Township Code of Ordinances and other Township ordinances, resolutions and regulations.
4. 
All applications must comply with the provisions of the Zoning Ordinance [Chapter 27]. The plan shall be designed and developed in accordance with any and all conditions which have been imposed upon the grant of a special exception, variance or conditional use approval by the Zoning Hearing Board or Board of Supervisors, as applicable.
5. 
All applications must comply with applicable provisions of the Township Construction Code [Chapter 5, Part 1]. Where provisions of this chapter conflict with provisions of the Township Construction Code [Chapter 5, Part 1], the more stringent provision(s) shall be applied. Approval of the subdivision or land development plan by the Township will not guarantee full compliance with the Township Construction Code [Chapter 5, Part 1] upon application for permits or in the future.
6. 
All subdivisions and land developments shall comply with the requirements of the Township Driveway and Street Access Ordinance [Chapter 21, Part 2].
