All children under 18 years of age shall hereafter be prohibited
from idling, loafing or being on any of the streets, alleys or other
public places, or in any taproom, club, place of amusement or similar
establishment, or in any enclosure or vehicle which is on or in close
proximity to any such public place in the Township of Spring after
the hour of 10:00 p.m. from the first day of October to the first
day of April, inclusive and after the hour of 11:00 p.m. from the
first day of April to the first day of October, inclusive, unless
such child shall be accompanied by a parent, guardian or other person
having the legal care or custody of such child or unless such child
bears a written statement dated that day and signed by a parent or
guardian, stating that said child is no an emergency errand, or unless
said child is lawfully employed during said hours and bears a written
statement of the parent or guardian and of the employer attesting
to such employment. Provided, however, that the curfew hour shall
be extended to 12:00 midnight for children attending properly chaperoned
school events or social events within the Township or returning from
the same. All children under 16 years of age shall hereafter be prohibited
from idling, loafing or being in or about any taxi station, railroad
station, bus station or other similar place within said Township after
the hour of 9:00 p.m. on any day of the year except in the company
of a parent or adult guardian.

It is hereby made unlawful for any parent, guardian or the person
having legal care or custody of the child under the age of 18 years
to allow or permit such child to violate any of the provisions of
this Part.

Any child as above designated found upon any of the Township's streets or alleys or in any of the parks, tap rooms, clubs, places of amusement or similar establishments within the Township, in violation of § 6-101 of this Part, shall be taken into custody by the Township Police and delivered to his or her parents, guardian or person having the legal custody of such child and report thereof shall be made immediately to the Township Secretary, who shall make a record thereof in a book to be kept that purpose. If said parent, guardian or person having the legal custody of such child shall again allow him or her to be on said streets, alleys, parks or public places in violation of § 6-101 of this Part, said parent, guardian or person having the legal custody of said child so offending, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense. Any child violating this Part who does not immediately disclose his or her place of residence, or if the residence be not in the Township of Spring, the Police Officer shall take such child to the Township office or other place of detention for questioning and investigation. Any child, whether resident or nonresident of the Township, who shall violate this Part three or more times shall be reported to the proper juvenile authorities of the County.

The police officers of the Township in taking children into
custody shall use their discretion in determining age and in doubtful
cases may require positive proof, and until such proof is furnished,
the officers' judgment shall prevail.

It is hereby declared that the purpose of this Part is to reduce
juvenile delinquency and it is further declared to be the intent of
this Part that its provisions shall be liberally construed so as to
effectively cure or reduce juvenile delinquency, either on the part
of children within the Township or nonresident children coming into
the Township.
