A. 
The Town Attorney shall be elected at the General Election of Town officers and shall hold his/her office for a term of two (2) years, and until his/her successor shall have been duly elected or appointed and qualified. The Town Attorney shall be, at the time of his/her election, at least twenty-one (21) years of age, a citizen of the United States, a resident of the State of Missouri, and shall have resided in the Town of Carrollton for a period of at least one (1) year immediately prior to his/her election, and shall be duly licensed and actively engaged in the practice of law in the State of Missouri.
B. 
If there is no Attorney meeting the requirements of Subsection (A) of this Section, then an Attorney shall be appointed for a term of two (2) years.

The Town Attorney shall conduct and carry on all civil suits, actions and proceedings on behalf of the Town, shall represent the Town in all legal matters in which the Town is a party or interested and shall prosecute all persons charged with violating the ordinances of the Town. When so instructed by the Council, he/she shall prosecute all suits instituted for the collection of delinquent and back taxes or proceedings brought to enforce payment of any other tax, license or revenue whatsoever due the Town.

There is hereby authorized the Town Council of the Town of Carrollton, the authority to employ the services of an attorney, group of attorneys, or professional legal corporation to perform services of a legal nature for the Town as further described to include meeting with the Council at regular, adjourned or special meetings. The Town Counselor shall advise the Council or any committee or member thereof, the Mayor, the heads of all departments of the Town government, the duly elected Town officers concerning any legal questions affecting the Town's interests. He/she shall draft all proposed Town ordinances; he/she shall prepare, or officially approve, as to form, all contracts, deeds, bonds, and other documents to be signed in the name of or made to, with or for the benefit of the Town. He/she shall perform such other legal duties as the Council made by ordinance or resolution require.

The Town Attorney and the Town Counselor shall be allowed upon approval of the Town Council to charge such additional sums for expenses and extraordinary time involved in the tending to Town business through drafting and writing all ordinances, resolutions, contracts, deeds, and other legal papers or defending or prosecuting any suit wherein the Town of Carrollton is a party. Such sums allowed by reasonable commensurate with the usual customary attorney fees for like work.
