There is hereby created the appointed position Chief of Police
in the Town of Carrollton, Missouri, said position to be filled by
appointment of the Mayor of the said Town with the consent of the
Town Council and the appointee thereto shall hold office at the pleasure
of the Town Mayor and Town Council. The Chief of Police cannot be
fired, suspended or his/her appointment otherwise terminated except
by consent of the Town Council.

The Chief of Police must be a citizen of the United States of
America and be at least twenty-five (25) years of age and be of good
moral character.

The Chief of Police shall obey and carry out the instructions
of the Mayor in relation to any violation of the Town ordinances,
and shall perform such duties as are required by ordinance and that
may be ordered by the Mayor, provided that nothing in this Section
shall be so construed as to relieve the Chief from any duty imposed
upon him/her either by any ordinance of the Town or the Laws of the
State of Missouri as pertaining to Chief Law Enforcement Officers
of cities, towns and villages.

The Chief of Police shall be the Chief Law Enforcement Officer
of the Town and perform such duties as are imposed on him/her by the
laws of this State and such as may by ordinance be prescribed by the
Council; and subordinate and subject to the orders of the Mayor; shall
have control of the entire police force of the Town except for the
actual hiring and firing of regular policeman, and shall direct the
movements and assign the duties of each member thereof.

It shall be the duty of the Chief of Police to keep the Mayor
informed of anything leading to a reasonable apprehension of a breach
of the peace within the Town or a breach of any of the ordinances
of the Town; and to report to the Town Attorney all breaches of the
ordinances or breaches of the peace within the Town, and to aid and
assist him/her in procuring all evidence in relation thereto and to
make written complaint against any person, who, to his/her personal
knowledge is guilty of a breach of the peace within or a breach of
any ordinance of the Town.

The Chief of Police shall collect all fines, costs, forfeitures,
and penalties for breaches of the ordinances of the Town of Carrollton,
and shall keep a true and correct record of all monies collected as
fines, fees, costs, forfeitures and penalties made and imposed, with
the date, the nature of the offense and the name of the party against
whom it is charged, and showing the names of persons and the amounts
of fees and costs due them in each case; and shall pay over to the
treasurer of said Town of Carrollton, all monies collected and received
by him/her as fines, forfeiture and penalties, and take receipt for
same.

As often as the Council may require, the said Chief of Police
shall make a report, in writing, to the Council of all fees collected
by him/her or which he/she is entitled to collect as such officer
under existing laws and ordinances now in force in relation to his/her
office.

It shall be the duty of the Chief of Police to serve and execute
all warrants, subpoenas, attachments, summons and all other process
issued by the Police Judge, anywhere within the limits of the Town.
He/she shall be a conservator of the peace within said Town, and for
all breaches of the peace within said Town, or breaches of the ordinances
of said Town, he/she shall have power and authority, and it shall
be his/her duty to enter any house, building, enclosure, or other
place or any public ground or space within said Town where a breach
of the peace or any ordinance has been, or is about to be, or is being
committed and arrest the offending party or parties without a warrant
from the Police Judge. He/she shall have the power and authority,
and it shall be his/her duty, in all breaches of the peace within
said Town, or breaches of any ordinances, which has been, or is about
to be, or is being committed not in his/her presence to enter any
house, building, enclosure or public place, or on any public place
or ground within said Town, and arrest the person or persons whom
he/she has reasonable suspicion of being the offending party without
a warrant from the Police Judge.

In addition to the above, it shall be the duty of the Chief
of Police, when he/she has any knowledge, or reasonable suspicion,
or when notified by the Mayor or any Councilman, or any person, that
a breach of the peace within said Town, or a breach of any ordinance
has been, or is about to be, or is being committed, to proceed at
once, with full power and authority to enter any enclosure, building,
or other place or public ground as stated in the proceeding Sections,
and preserve the peace, prevent the breach of the peace, or breach
of any ordinance, and enforce the ordinances of the Town and protect
the rights and property of all persons and arrest the offender.

The Chief of Police shall have the power to summon all male
adults of the Town to aid in the enforcement of the law in all cases
where a breach of the peace within said Town or a breach of any ordinance
of said Town has been, or is about to be committed. He/she shall remove,
or cause to be removed, from all houses, buildings, enclosures, streets
and other public places, any and all things that may obstruct the
streets or sidewalks and anything tending to endanger the health of
the inhabitants of the Town.

In addition to the duties above set out, the Chief of Police
shall perform all those duties formerly imposed upon the position
of Town Constable by ordinance or ordinances prior to the enactment
of Ordinance No. 866 of the Town of Carrollton, Missouri.
