The Pennsylvania Sewage Facilities Act of 1966, P.L. 1535, 35
P.S. § 750.1 et seq., having been duly adopted, provides
by § 7 thereof that no person shall install an individual
or community sewage disposal system without first having secured a
permit. The Board of Commissioners of the Township of Lower Macungie,
in order to implement the enforcement of the Sewage Facilities Act,
does hereby accept the rules and regulations of the Department of
Environmental Protection, 25 Pa.Code, Chapter 73, "Standards for Onlot
Sewage Treatment Facilities," which provides regulations for the administration
of the Sewage Facilities Act and the issuance of permits in accordance
with standards provided therein. Said permits shall contain all of
the information required by § 7 of the Sewage Facilities
Act, 35 P.S. § 750.7, and shall be issued by the Secretary
of the Board Commissioners or by the agent or employee duly employed
by the Board of Commissioners and charged with the enforcement of
said Sewage Facilities Act.

No person, firm, or corporation shall construct, alter, or extend
any individual or community sewage disposal system within the Township
unless he holds a valid permit issued by the person or officer charged
with the issuance thereof. Permits shall be issued, if they comply
with the Pennsylvania Sewage Facilities Act, 35 P.S. § 750.1
et seq., and the rules and regulations issued in connection therewith,
upon the payment of such fees as are established from time to time
by resolution of the Board of Commissioners. The term "individual
sewage disposal system" shall mean one system per residential unit.
"Community sewage systems" shall mean sewage disposal units as described
in the rules and regulations of the Department of Environmental Protection,
and permits therefor shall be issued upon the payment of such fees
as are established from time to time by resolution of the Board of
Commissioners.

Appeal from refusal to grant permits and inspection of installations
of individual or community sewage disposal systems shall be as provided
by the Sewage Facilities Act, 35 P.S. § 750.1 et seq., and
the rules and regulations as promulgated thereunder, a copy of which
shall always be kept at the office of the Township Commissioners of
the Township of Lower Macungie, where the same may be inspected during
office hours.

Any person, firm, or corporation who violates any of the provisions
of this chapter, or any provisions of any regulation adopted by the
Township of Lower Macungie relating thereto, shall be subject to the
enforcement and remedy provisions of Parts 12 and 13 of this chapter.

In any case where a provision of this chapter is found to be
in conflict with a provision of any zoning, building, fire, safety,
or health ordinance or code of the Township existing on the effective
date of this chapter, the provision which establishes the higher standard
for the promotion and protection of the health and safety of the people
shall prevail. In any case, where a provision of this chapter is found
to be in conflict with a provision of any other ordinance or code
of the Township existing on the effective date of this chapter which
establishes a lower standard for the promotion and protection of the
health and safety of the people, the provisions of this chapter shall
be deemed to prevail, and such other ordinances or codes are hereby
declared to be repealed to the extent that they may be found in conflict
with this chapter.
