Every owner of property in the Township of Cumberland shall, upon notice from the Board of Supervisors, through the Zoning Officer or his or her designated employees, construct or reconstruct either a sidewalk and curb, or both, as specified in the notice, which work shall conform to all applicable requirements of this Part or any later ordinance, in front of or along side of such property within the time period specified in the notice but not less than 60 days. The property owner is the owner of the sidewalk which is subject to the Township's public right of way.

Every owner of property in the Township of Cumberland shall on 30 days' notice from the Board of Supervisors, through the Township Manager or his or her designated employee, repair the sidewalk or curbing, or both, in the manner stipulated in such notice, in front of or along side of such property.

All sidewalks and curbing shall be constructed, reconstructed or repaired in accordance with this Part and according to the Township of Cumberland Construction Standards and Specifications for Cement Concrete Curb and Sidewalk, except in those locations where specifications of the Pennsylvania Department of Transportation apply.
A. 
Repair of Existing Sidewalks. Existing sidewalks lawfully constructed of brick, stone, concrete or other materials may be continued to be maintained and may be rebuilt with the material of which sidewalks are now constructed.

The Township Engineer, Zoning Officer, Road Superintendent or his or her designated employee may, at any time during the course of work of construction, reconstruction, or repair of any sidewalks or curbing, visit the site of such work to ascertain whether or not such work is being done according to the requirements of this Part of the Code of the Township of Cumberland and shall visit any such site for such purpose whenever requested by the property owner. Within five days after the completion of the work of construction, reconstruction or repair of any sidewalk or curbing, it shall be the duty of the owner of the property where such work was done to notify the Township of the fact so that he or she may cause the same to be inspected to determine whether the grade thereof has been observed and followed.

Any property owner, upon his or her own initiative and without notice from any Township authority, may construct, reconstruct or repair a sidewalk or curb in front of or alongside his or her property, provided that such owner shall first make application to the Township and shall conform to the requirements of this Part and shall not violate any ordinance of the Township as to materials used, and the he or she shall notify the Township within five days after completion of the work.

Upon the failure of any owner of property in the Township of Cumberland to construct, reconstruct or repair any sidewalk or curbing after notices have been given in accordance with this Part, the Township may cause the necessary construction, reconstruction or repair thereof to be done at the expense of said owner, either by employees of the Township of Cumberland or by contract between the Township of Cumberland and paving and curbing contractors, lawfully entered into, and may collect the cost thereof and all additional charges, expenses and penalties as authorized in the Township Code as amended. All inferior work shall be removed and corrected at the expense of the property owner.

The owners, agents-in-charge, tenants or occupiers of all properties in the Township of Cumberland are hereby required to cause the sidewalks and pavements abutting (either in the front of the property, the rear of the property or on the sides of the property) their respective properties at all times to be kept clear of ice or sleet or to cause ice or sleet upon the sidewalks and pavements aforesaid to be at all times sprinkled with salt or sand or other similar substances or materials in such a manner that the sidewalks and pavements shall be safe for pedestrian traffic.

The owners, agents-in-charge, tenants or occupiers of all properties in the Township of Cumberland shall clear or cause to be cleared a pathway on the sidewalk of their respective properties or sidewalks on land abutting their property (either in the front of the property, the rear of the property or on the sides of the property) in the event of snow. Such pathways shall not be less than 30 inches in width and shall be thoroughly cleared of snow and ice or covered with salt or sand or similar substances or materials within 24 hours after the cessation of the snowstorm.

No owner, agent-in-charge, tenant or occupier of the properties aforesaid, in removing or causing to be removed snow from the sidewalks, shall throw or cause to be thrown or blown snow into the abutting street but shall throw or cause to be thrown or blown such snow into the area inside the sidewalk lane or between the sidewalk and the curb or otherwise dispose of and remove said snow.

Any person, corporation, owner, developer or general contractor who fails to comply with the provisions of this Part within 24 hours after snow or sleet has ceased to fall shall be fined not more than $600 for each offense for the use of the Township of Cumberland, together with costs, and upon default of payment of said fine and costs, shall be imprisoned for a period not to exceed 30 days at the Adams County Prison.
