This Part shall be known as the Franklin Township "Refuse Ordinance."

All persons in Franklin Township shall provide storage facilities
for any accumulation of refuse in order to prevent the attraction,
harboring or breeding of insects or rodents and to eliminate conditions
harmful to the public health or which create safety hazards, odors,
unsightliness and public nuisances.

All refuse accumulated and to be transported from any property
in Franklin Township shall be collected, conveyed, and disposed of
only at a landfill approved by the Pennsylvania Department of Environmental
Protection and operated by the Southeastern Chester County Refuse
Authority or any other facilities specifically designated by the Chester
County Solid Waste Management Plan to receive waste generated in Franklin
Township.

1. All refuse shall be transported in such a manner as to prevent public
health, safety hazards and nuisances.
2. Collection personnel operating or otherwise assigned to collection
vehicles shall be responsible for the immediate cleaning up and removal
of refuse or garbage that may be spilled or scattered during the process
of collection.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a Magisterial District Judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not less than $25 and not more
than $1,000 plus costs and, in default of payment of said fine and
costs, to a term of imprisonment not to exceed 90 days. Each day that
a violation of this Part continues or each section of this Part which
shall be found to have been violated shall constitute a separate offense.

All persons shall comply with applicable laws, ordinances, rules
and regulations of this Township and/or the Commonwealth of Pennsylvania
relating to the collection, transportation, storage or disposal of
solid waste. Nothing herein shall be deemed to be inconsistent with
any present law or laws hereafter enacted requiring the separation
of refuse for recycling.
