There is hereby levied and assessed upon each property in and served by the Borough of Kittanning by the collection and disposal of garbage, rubbish and bulky wastes a fee or charge to help defray the cost and expense to said Borough of such service.

By resolutions duly adopted by the Council of the Borough of Kittanning, the amount of the fee or charge may from time to time be increased or decreased; provided, however, that such increase or decrease shall not apply to services already rendered but shall be prospective only.
All fees or charges levied and assessed by or pursuant to this article and its supplements and amendments, are imposed for the refuse collection and disposal service of the Borough of Kittanning and shall be charged and periodically billed to and collected from the owners of properties served.
The Council of the Borough of Kittanning may, by resolution from time to time duly adopted, establish or abolish prompt payment discount on fees and charges imposed under this article and impose or abolish interest and penalties upon all such fees and charges not paid when due.
All fees or charges, penalties and interest imposed by or pursuant to this article and its supplements and amendments, shall be recoverable for the Borough of Kittanning by its Solicitor as debts of like amounts are by law recoverable or in any other manner provided by law for the collection of a municipal claim.
All fees or charges imposed by or pursuant to this article, and its supplements and amendments, shall be billed for and collected monthly after the service is performed and shall be paid within 30 days after the date of billing. Nonpayment beyond such thirty-day period shall render the same delinquent.

A penalty of 6% per month of the principal amount of every delinquent bill assessed pursuant to this article. A "delinquent bill" is defined as any bill not paid within 31 days of the posting of said bill to the customer.
All delinquent accounts for said fees or charges, interest or penalties are subject to stoppage of collection and disposal service without notice. Service shall be resumed thereafter only on payment of the accumulated fees or charges for the period of collection and period of noncollection, plus interest, penalties and costs of suit. The stoppage of such services by the Borough of Kittanning for nonpayment of such fees or charges shall be in addition to the right of the Borough to proceed for the collection of such unpaid fees or charges, interest and penalty as hereinbefore provided. The stoppage of such service by the Borough shall render the person or entity owning the property in question delinquent in payment thereof, in violation of Ordinance No. 13-1964,[1] as supplemented and amended, of said Borough if such stoppage continues beyond the next regularly scheduled refuse collection day for that property, and such person or entity shall then be subject to the penalties imposed by that ordinance.

The fee or charge under Ordinance No. 13-1964, as most recently amended, is as follows:
A.
For each private dwelling one-family or one-family apartment unit, the sum of $30 for garbage plus $2 for recycling for each calendar month. Multifamily dwelling units shall pay this same fee, multiplied by the number of dwelling units in the building. Each one-family dwelling unit shall be subject to the three-approved-garbage-container minimum, and for each approved container in excess of three, an additional charge of $11 per approved container shall apply.[1]

B.
For each multifamily unit, the following rate schedule is established which rate schedule shall include recycling fees:

Fees for multifamily units in excess of 100 units will be established as needed by further regulation of the Council.
C.
Hotels, restaurants and other commercial establishments excluded from this Borough service under Ordinance No. 13 of 1964 as supplemented and amended are exempt from liability for the fees and charges established hereby. Hotels, restaurants and other commercial establishments excluded from this Borough service may be entitled to receive Borough service for the collection and disposal of garbage, rubbish and bulky waste, provided that the owners of such establishments use a movable dumpster, the design and manufacture of which shall comply with Borough regulations as from time to time established. The cost for trash removal from such establishments using dumpsters shall be $200 per month for dumpsters having a capacity of two cubic yards and $325 per month for dumpsters having a capacity of four cubic yards.
