Editor's Note: This ordinance was adopted as Ch. 162 but was

As used in this chapter, "fire lane" and "fire zone" shall be
interchangeable. A "fire lane" or "fire zone" is hereby defined as
an area designated under this chapter that may be part of a traffic
circulation system and/or area of ingress/egress adjacent to a building,
either on private property or within a municipal street, or other
designated locations as to provide an immediate and unobstructed route
and/or access for firefighting, or other associated emergency, operations,
equipment, and personnel.
The Borough of Longport Fire Chief shall designate all fire
lanes and fire zones on private property. The Borough of Longport
Fire Chief, in consultation with the Borough Chief of Police and Borough
Engineer, shall designate and recommend to the governing body for
adoption all fire zones and fire lanes within municipal streets. Such
designated fire lanes/zones on public streets shall be established
by ordinance only.

The following streets are hereby established as fire zone locations:

It shall be the responsibility of the Borough of Longport to
establish and maintain all fire lanes/zones within public rights-of-way.
It shall be the responsibility of the owner(s) or operators(s) of
the private premises upon which the fire lane/zone is being established
to install appropriate identification at his/her expense. All fire
lane/zone markings shall be maintained and be legible at all times
in accordance with the following:
A.
Striping and curbs. Where applicable, fire lanes/zones shall be identified
by painting on-site curbs (not those within public rights-of-way)
yellow and be striped with four-inch-wide continuous yellow lines
placed diagonally from the curb or road edge and shall be outlined
along their entire perimeter. Fire lane/zone widths and lengths shall
be designed in accordance with the direction of the Municipal Fire
Chief.
B.
Pavement lettering. The legend "No Parking Fire Lane/Zone" shall
be placed within the striped area of the designated fire lane/zone
at a minimum of one-hundred-foot intervals or as directed by the Municipal
Fire Chief. All lettering shall be 18 inches in height and yellow
in color.
C.
Signage. In areas where striping cannot be utilized, a "No Parking"
sign in conformance with current MUTCD Standards shall be posted with
the words "No Parking Fire Lane/Zone". Signs shall be 12 inches in
width by 18 inches in height with red lettering, two inches in height,
on a white reflective background. Signs shall be erected at the beginning
and end of each fire lane zone and spaced at intervals within the
fire lane/zone as determined by the Municipal Fire Chief, but no more
than 100 feet between signs. Signs shall be placed on acceptable metal
sign posts with the sign face not less than seven feet above existing
grade. All signs faces shall face oncoming traffic. If acceptable
to the Fire Chief, signs may be placed on existing structures or sign
supports.
The Municipal Fire Chief or the Municipal Police Department
shall have jurisdiction to enforce the provisions of this chapter.
A.
Any person violating this chapter shall, upon conviction thereof,
be punishable by one or more of the following: a period of community
service not exceeding 90 days and/or a fine of not less than $250
nor more than $1,500 at the discretion of the presiding Judge.
B.
Any person who is convicted of violating the provisions of this chapter
within one year of the date of the previous violation of the same
chapter and who was fined for the previous violation shall be sentenced
by the Court to an additional fine as a repeat offender. The additional
fine imposed by the Court for a repeated offense shall not be less
that the minimum or exceed the maximum fine fixed for a violation
of this chapter, but shall be calculated separately from the fine
imposed for the original violation of this chapter. Whenever such
person shall have been officially notified or by service of a summons
in a prosecution, or in any other official manner, that said person
is committing a violation; each day's occurrence shall constitute
a separate offense, punishable by a fine or penalty.
