It shall be unlawful for any person, directly or indirectly, upon any pretense or by any device, to sell, exchange, barter, dispose of or give away, or keep for sale any cigarettes, cigarette paper or cigarette wrappers or any paper made or prepared to be filled with tobacco, without first obtaining a license therefor. All premises where cigarettes are sold shall have a license.

Every person desiring a cigarette license shall file with the city clerk a written application therefor, stating the name of the person and the place for which such license is desired. Every license shall be signed by the city clerk and shall name the licensee and the place where he or she may conduct such business and the same shall not be delivered until the applicant shall produce and file with such clerk a receipt showing the payment of the required license fee to the treasurer of the city.
Each license shall be approved by the council or a standing committee of the council, if authorized by the council, and shall be effective for one year, from July 1 through June 30.
A person may be issued a cigarette license for a planned event. No person shall hold more than one planned event license at any time and not more than two planned event licenses shall be issued to the same person in any year. In this subsection a "planned event" means a special event or a family, social, civic, community or business event which is expected to continue for not more than 10 days.
The fee for an annual license or a license issued upon a change of ownership shall be set by resolution of the council.

A person who violates any provision of this section shall upon conviction be subject to a Class 3 forfeiture.
