As used in this article, the following terms shall have the
meanings indicated:
DUMPSTER
A device or container one cubic yard or more in size used
or intended for the use of bulky waste, construction debris, refuse
and like materials.
TEMPORARY CONSTRUCTION DUMPSTER
A dumpster that is used in connection with construction,
demolition or for similar temporary means and requires a dumpster
license, which license shall be issued for a period not to exceed
30 days, renewable for additional thirty-day periods upon application,
not to exceed a total period of 12 months.
Any person, persons, firm or corporation who shall violate any
of the provisions of this article shall, upon conviction thereof,
be punishable by a fine of not less than $50 nor more than $500 together
with the costs of prosecution and, in default of the payment of the
fine and costs, by imprisonment for a term not to exceed 30 days.
Such fine and penalty may be collected by suit brought in the name
of the Borough before any Magisterial District Judge in like manner
as debts of like amount may be collected by existing laws. Each day
that a violation is permitted to exist shall constitute a separate
and distinct offense.
