The objectives of this Article are to establish requirements for placing, installing and maintaining signs, in order to preserve and protect the health, safety, welfare and general well-being of the community's citizens. Just as regulations for the placement, construction and maintenance of buildings and structures through zoning is a valid use of the law so are regulations for the placement, installation and maintenance of signs a valid use of the law, because signs, in the literal sense, must be considered structures, and, in a practical sense, are capable of producing many of the same nuisances as buildings produce.
Sign regulations are further justified by the primary purpose of a sign: to draw attention to its content. However, since signs can distract drivers or obstruct views, the very nature of a sign can be a potential hazard to the safety of the motoring public. Therefore, it is the intent of this Ordinance to regulate the location of signs in such a way that they can fulfill their purpose without causing unsafe conditions for motorists.
Finally, it is the objective of this Article to protect and preserve the visual character of the community by regulating the placement, installation and maintenance of signs. Because signs are intended to command visual contact this gives them an important role in the overall visual character of a community. This visual impact is an economic fact that affects the value of property, as well as its enjoyment. Therefore, the regulation of signs can work to conserve the value of property and encourage the most appropriate use of land throughout a municipality. Good planning requires a community's residents to plan the physical surroundings in such a way that visual clutter is minimized.
With this purpose in mind, it is the intention of this Article to authorize only those uses of signs which are:
A. 
Compatible with their surroundings;
B. 
Appropriate to the type of activity or function to which they pertain;
C. 
Expressive of the identity of the individual proprietors or of the community as a whole; and legible in the circumstances in which they are seen.

A. 
Electronic Message Center (EMC). A sign, or portion thereof, that displays animated images, moving video images, graphics, or scrolling messages, electronic images, static images, static graphics or static pictures, with or without textual information. EMCs are capable of change or alteration by electronic means on a fixed display screen composed of a series of lights including light emitting diodes (LED's), OLEDs LCDs, DLPs, plasma, fiber optics, lights bulbs, or other illumination devices within the area where the message is displayed. EMCs include computer programmable, microprocessor controlled electronic or digital displays. EMCs include signs that utilize technology not listed in this definition and shall include similar technology which may be developed in the future, or the use of which may become widespread in the future.
B. 
Facia Sign. A sign attached to, placed upon, or hung from any covered structure projecting from and supported by a building and which extends beyond the facade of the building, such as a canopy, an awning, etc.
C. 
Freestanding Sign. A sign permanently supported by upright or uprights which are permanently anchored into the ground. This may have two display sides.
D. 
Official Traffic and Highway Sign. Official highway route number signs, street name signs, directional signs, and other traffic signs erected and maintained on public highways and roads in the interest of public safety or for the regulations of traffic.
E. 
Outdoor Advertising Sign. A type of free-standing sign which directs attention to a business, industry, profession, commodity, service, or entertainment not sold or offered on the premises where the sign is located.
F. 
Portable Sign. Any sign, including vehicular signs, not permanently attached to the ground or a building.
G. 
Roof Sign. A sign on or above the roof or the eaves of a building.
H. 
Tourist Oriented Directional Signing ("TODS") Sign. A sign meeting the requirements of § 1.7 of the Pennsylvania Department of Transportation ("PennDOT") Traffic Engineering & Operations Manual - Tourist Oriented Directional Signing (TODS) Policy and approved there under by PennDOT. A TODS Sign shall be located within the right-of-way of a street and provide the name and directional guidance to an attraction that the traveling public would have a reasonable interest in.
I. 
Wall Sign. A sign mounted parallel to the face of a structure and not projecting above the eaves of the structure nor more than 12 inches from the plane or facade of the structure.
J. 
Window Sign. A sign mounted or painted on a window or inside a structure such that it can be seen through the window.

Under this Article, the erection of any sign is regulated unless a sign is specifically excluded from regulation. The erection shall include any building, construction, attachment, hanging, suspension, alteration, structural repair, removal, relocation, demolition, renewal or painting of a sign on any wall, roof, or any other background surface. To find out whether one or more signs are permitted on a premises, and, if so, what type of sign, what size and height, where it may be erected, how it is to be erected and maintained, the following procedure shall be followed for the use of this Ordinance:
A. 
Applicability. Refer to § 1104 to determine whether a proposed sign is:
1. 
Exempt from the provisions of this Ordinance;
2. 
A prohibited sign; or
3. 
A permitted sign which is:
a. 
A temporary sign; or
b. 
A permanent sign.
B. 
Regulations. If a sign is permitted to be erected on the premises involved, the following regulations must be met in order to properly design and locate it:
1. 
Refer to § 1103 to determine:
a. 
Where a proposed sign may or may not be located on a premise; and
b. 
The general construction requirements.
2. 
Refer to §§ 1105 and 1106 for specific sign regulations for various uses.
3. 
Refer to § 1107 for additional requirements, if the property is located in a historic district.
C. 
Request for a Permit. If the requirements and regulations in the preceding steps have been satisfied, then contact your local zoning officer for:
1. 
A sign permit application, fee information and inspection requirements; and
2. 
Information on drawings which are necessary for a complete application for a sign permit and the necessary requirements for each drawing.

A. 
Area of a Sign.
1. 
The area of a sign shall be construed to include all lettering, wording, and accompanying designs and symbols, together with the background, whether open or enclosed, on which it is displayed but not to include any supporting framework, bracing, or decorative trim which is incidental to the copy content of the display itself.
2. 
In the computation of square foot area of a double-faced sign or multiple-faced sign, only one side shall be considered, provided all faces are identical in size. If the interior angle formed by the faces of a double-faced or multiple-faced sign is greater than 90°, then all sides of such sign shall be considered in calculating the sign area.
3. 
A sign supported by more than one means (and therefore to which more than one type definition may be applied such as freestanding, wall, roof, projecting sign, etc.) shall have its area and height calculation determined by the type definition which has the most restrictive standards.
B. 
Height of a Sign.
1. 
The maximum height to the top of a freestanding sign shall be measured from the ground level where the sign is mounted. The height of an earth mound on which a sign is mounted shall be included in the allowable height.
2. 
A sign must be contained within the building height restrictions of the zoning district in which it is located.
C. 
Location of a Sign.
1. 
No sign shall be placed in such a position as to endanger traffic on a street by obscuring view or by interfering with official street signs or signals by virtue of position, color, or reflective surface.
2. 
A sign located along the right-of-way of a state or federal highway shall comply with any requirements of the state or federal government relating thereto, which are more restrictive than those of this Ordinance.
3. 
Except in the case where a local right-of-way abuts a structure, except within historic districts, and except for signs of governmental authority:
a. 
No sign is permitted within an existing street legal right-of-way.
b. 
No sign shall be erected or maintained nearer to an existing street right-of-way or lot line than four feet.
c. 
No sign extending more than three feet above the road level shall be permitted within a sight triangle defined by 15 feet distances along the nearest edge of the accessway and the street right-of-way.
d. 
Except within VC-1, VC-2, TC and TC-2 Districts, there shall be a minimum distance of 20 feet between any side property line and any sign erected under the provisions of this Article.
e. 
The lowest edge of a projecting sign shall not be less than 7 1/2 feet above the sidewalk or ground level elevation.
4. 
Properties Located along Limited Access Portion of the Route 332 and Route 413 Bypass. No sign located within 1,000 feet of the Route 332 or the Route 413 Bypass legal rights-of-way shall face onto the Bypass.
5. 
Properties Located Along Non-Limited Access Portion of the Route 332 and Route 413 Bypass. No sign located within 1,000 feet of the Route 332 or the Route 413 Bypass legal rights-of-way shall face onto the Bypass so that the message or symbol on the sign may be visible from any location within the Bypass legal rights-of-way, except as provided in § 1110, Business Complex Identification Signs, along the Routes 332-413 Bypass or § 1111, Signs for Individual Uses and Individual Uses Within a Business Complex Along the Routes 332-413 Bypass.
D. 
Illumination of Signs. A light illuminating a sign shall be so arranged that the source of light is not visible from any point off the lot and that only the sign is illuminated thereby. An illuminated sign must also conform to the provisions of § 1004. This illumination may be:
1. 
Direct. Illumination of a sign designed to give forth artificial light directly through transparent or translucent materials from a source of light within such sign;
2. 
Indirect. Illumination of a sign with a light so shielded that no direct rays therefrom are visible elsewhere than on the lot where said illumination occurs.
3. 
Electronic message centers are prohibited within the Jointure.
E. 
Construction of Signs.
1. 
Supports for a sign or sign structure shall conform with the requirements set forth in the BOCA Building Code and/or building code adopted by the municipality.
2. 
The supports for a sign or sign structure shall be located upon private property.
3. 
A sign using electricity shall be installed in conformance with the latest National Electric Code (NEC). Every sign permitted in this Part must be constructed with durable materials and must be kept in good condition and repair, or must be removed.

A. 
Signs Exempt from this Ordinance. The following signs, to the extent indicated, are exempt from the provisions of this Ordinance:
1. 
Street Sign. Official highway sign, street name, directional or other traffic sign erected in accordance with the Pennsylvania Motor Vehicle Code.
2. 
No Trespassing Sign. A sign not exceeding two square feet, indicating the prohibition or control of fishing, hunting, trespassing, etc., or a sign indicating the private nature of a road.
3. 
Residential Identification Sign. A sign, not exceeding two square feet, and placed not more than five feet high bearing only property number, street address, post box number and/or the names of the occupants of a residence, or the name of the dwelling, except those in historic districts.
4. 
Governmental Flag or Insignia. Providing same does not exceed seven feet in width and 11 feet in length and is affixed to a pole no higher than 35 feet. This limitation shall not apply to flags flown by Federal, State or Municipal governments.
5. 
Legal Notice.
6. 
Window Sign. A sign applied to a window pane giving store hours or the name or names of credit or charge institutions, when the total area of any such sign or all signs together does not exceed one square foot.
7. 
Crop Identification Sign.
8. 
Cornerstone.
9. 
Barber Pole. Revolving barber shop pole sign provided that it does not exceed 36 inches in height and that it is erected only in a commercial district in conjunction with a barber shop.
10. 
Temporary Sign Advertising Mechanics, Artisans, Contractors and/or Architects. A temporary sign erected and maintained during the period any of the above are performing work on the premises. No one sign shall exceed four square feet. Only one sign may be erected for each business or contractor. There shall be no more than four such signs displayed on the property at any one time.
11. 
Temporary Window Sign. A sign displayed only for a period not to exceed 14 days. The total window area covered by all temporary window signs shall not exceed 10%.
12. 
Yard Sale Sign. An on-site sign advertising a yard sale provided the sign does not exceed four square feet in area, remains up only during the sale but in no case longer than nine days and does not appear more than once every six months on the same premises. Not more than one such sign shall be placed on any given property on which the yard sale shall occur unless such property fronts on more than one street, in which case, one such sign shall be permitted along each street.
13. 
Public Sign. A public monument, historic or public park identification sign or plaque erected by a government agency. No more than one such sign shall be placed on a structure or building and no more than one such sign shall be placed at each entrance to the site. A public sign may be free-standing or wall. Its maximum area shall be eight square feet. Its maximum height shall be six feet when attached to a building or structure or five feet when freestanding. Such signs may be non-illuminated or indirectly illuminated.
14. 
TODS Sign along a State Highway. All TODS Signs shall comply with § 1.7 of PennDOT's Traffic Engineering & Operations Manual - Tourist Oriented Directional Signing (TODS) Policy. A TODS Sign installed along a State Highway shall not require a sign permit. The Township shall not be responsible for the cost, installation, maintenance, repair, or replacement of any TODS Sign. Any TODS Sign that becomes noncompliant with the PennDOT Manual shall be immediately brought into compliance or removed.
B. 
Prohibited Signs.
1. 
Any sign which states that a property may be used for a non-permitted use.
2. 
Any sign which flashes, rotates, revolves or oscillates (with the exception of barber poles).
3. 
Any sign which is illuminated by the use of an inert gas or any form of exposed tubes.
4. 
Any sign which emits smoke, visible vapors or particles, sound or odor.
5. 
Any illuminated sign in Residential, RI and RI-A - Rural Industrial, or QA - Quarry Agricultural Districts, except as provided for in this Article.
6. 
Any novelty sign, including but not limited to an object (e.g., tire, automobile, food product, etc.) except that novelty signs shall be permitted in the historic districts provided that the applicant demonstrates to the HARB's satisfaction that such proposed novelty sign has qualities reflective of novelty signs utilized in this region historically.
7. 
Any roof sign, except within the LI - Light Industrial District.
8. 
Any sign placed or maintained in such a manner as to interfere with any electric light, power, telephone or telegraph wires or the supports thereof.
9. 
Any sign which imitates any official traffic sign, signal or device.
10. 
Any sign which interferes with an official highway sign.
11. 
Any banner sign across a street or on any private property except for such temporary signs which are approved by the governing body to be of general benefit to the municipality or for public convenience, necessity or welfare and meeting the requirements of subsection C, Temporary Signs, below.
12. 
Any suspended pennant which blows in the wind or spinner which spins in the wind.
13. 
Any vehicle or trailer which is parked on a public right-of-way or on public or private property so as to be visible from a public right-of-way, which has attached thereto or located thereon any sign or advertising device for the basic purpose of providing advertisement of products or directing people to a business or activity located on the same or nearby property or any other premises. This Section shall not prohibit any form of vehicular sign such as a sign attached to a bus or lettered on a motor vehicle where the vehicle is not used for the basic purpose of providing advertisement or direction as set forth above.
14. 
Any off-premise sign except governmental signs and directory signs for service organizations and churches and except temporary signs displayed for a period not to exceed two weeks.
15. 
Temporary window signs in any historic district.
16. 
Electronic message centers shall be prohibited in all zoning districts within the Township.
C. 
Signs Requiring a Permit.
1. 
Temporary Signs.
a. 
Agency Sign for Single Property Sale or Rental. A sign advertising the sale or rental of premises upon which said sign has been erected or a sign indicating that said premises has been sold or rented, provided:
(1) 
Such sign shall be erected only on the premises to which it relates.
(2) 
The area of one side of any such sign shall not exceed six square feet on lots of two acres or less, or 15 square feet on lots larger than two acres.
(3) 
No more than one such sign shall be placed on any property held in single and separate ownership except that, where such property is greater than three acres and abuts more than one public street, one such sign may be erected on each street frontage.
(4) 
Such sign shall be removed promptly upon settlement or upon execution of a lease.
(5) 
Only one permit shall be required of a real estate agency within any one calendar year.
b. 
Multiple Property Sale or Development Sign. A sign advertising the sale or development of the premises upon which it is erected, when erected in connection with the development or proposed development of the premises by a builder, contractor, or developer or other person or persons interested in such sale or development, provided:
(1) 
Such sign shall be erected only on the premises to which it relates.
(2) 
The area of one side of any such sign shall not exceed 24 square feet in subdivisions or developments containing less than 10 lots, and 35 square feet in subdivisions, or developments containing 10 or more lots.
(3) 
No more than one such sign shall be placed upon any property held in single and separate ownership; except that, where such property is greater than five acres and abuts more than one public street, one sign may be erected on each street frontage.
(4) 
Such sign shall be removed within 20 days after the last premise has been initially sold.
c. 
Political Sign. Temporary signs advertising political parties or candidates for election may be erected and maintained, subject to the following provisions:
(1) 
The person or persons who erect political signs shall remove the signs within three days after a primary election if the signs were erected for a primary election, and within three days after a general election if the signs were erected for a general election. Any person who erects a political sign or any candidate advertised on a political sign that does not remove the sign within three days of either a primary or general election, whichever is applicable, shall have violated the terms of this Ordinance and shall, upon conviction, be subject to the penalties prescribed for violation of the Zoning Ordinance.
(2) 
There shall be no filing fee nor registration requirement to erect political signs.
(3) 
In keeping with the aesthetics of the Participating municipalities, it is requested that political signs erected pursuant to this Section be no greater than four square feet in area, but in no event shall any political sign be greater than 16 square feet in area, nor shall the cumulative square footage of political signs on any one tax map parcel be greater than 80 square feet.
(4) 
No political signs shall be erected on property owned by, or right-of-way controlled by, any of the participating Municipalities without the written consent of the governing body of the applicable municipality. This restriction shall include all street signs, traffic light standards, stop signs and other roadway signs. Political signs which are not removable, such as, but not limited to permanent bumper stickers, may not be erected or posted on public property.
d. 
Activity Sign. A sign advertising civil, social or political gatherings, or fund-raising activities, provided:
(1) 
A sign may be erected no earlier than 14 days prior to the activity to which the sign relates, except that in historic districts a sign may be erected no earlier than nine days prior.
(2) 
The application for the sign permit shall specify sign location(s).
(3) 
The applicant shall obtain written permission to erect such signs from all property owners involved or from the governing body if such signs are to be placed in the public areas controlled by that governing body.
(4) 
The size of any such sign is not in excess of 24 square feet. In historic districts the size shall not exceed eight square feet.
(5) 
No more than one such sign shall be permitted on a single lot or premises.
(6) 
The applicant shall deposit with the municipality, at the time of the application, a sum in an amount to be set by resolution of the elected officials of the municipality as a guarantee that all such signs shall be removed promptly within five days after the event referred to on the sign and to which the sign relates. The deposit shall be returned upon the satisfactory removal of such signs within the five-day period. If all such signs are not removed at the end of the five-day period, the municipality will then have them removed and keep the full sum deposited to reimburse the expenses incurred by the municipality.
e. 
Seasonal Agricultural Sign. A sign advertising seasonal agricultural products, provided:
(1) 
On-premises Temporary Sign.
(a) 
No more than one on-premises sign may be erected along the frontage of each street abutting the property upon which agricultural sales are conducted.
(b) 
The total area of each such sign shall be as follows:
[1] 
For properties larger than 10 acres in size, the sign shall not exceed 12 square feet, and the maximum height of the sign shall not exceed seven feet.
[2] 
For properties between one and 10 acres in size the sign shall not exceed five square feet, and the maximum height of the sign shall not exceed four feet.
[3] 
For properties less than an acre, the sign shall not exceed 1 1/2 square feet and the maximum height shall not exceed four feet.
(c) 
All such signs shall be removed within 10 days after retail sales have ceased for the season.
(2) 
Off-premises Temporary Sign.
(a) 
No more than four off-premises signs (permanent or temporary) may be permitted at any one time to identify a farm or agricultural use and/or any products for sale at said farm or use.
(b) 
The total area of any such sign shall not exceed 4 1/2 square feet, and the maximum height shall not exceed five feet.
(c) 
Such sign shall be placed not more than two miles from the farm or other agricultural use identified by the sign.
(d) 
No such sign shall be painted or placed on a utility pole or any natural feature such as a tree or rock. All such signs must be individually and independently supported and shall not be artificially illuminated.
(e) 
All applications for an off-premises temporary sign permit shall be accompanied by a document signed by each owner of property on which such off-premises sign would be placed, stating that the property owner has given permission to the applicant to place the sign on the property and stating the place of the sign for which such permission is granted.
(f) 
All such signs shall be removed within 10 days after the sales of the product advertised by the sign ceases for the season.
f. 
Commercial Sales. A sign advertising intermittent special commercial sales in districts where permitted, provided:
(1) 
The application for the sign permit shall specify sign location and dates.
(2) 
The sign may be erected only on the property on which the sale is to be held.
(3) 
The size of the sign is not in excess of 24 square feet. In historic districts the size shall not exceed eight square feet.
(4) 
No more than one such sign shall be permitted on a single lot or premises, except that if such property fronts upon more than one street, one sign may be erected on each frontage.
(5) 
Such sign shall not appear on any one lot or premises for more than 120 days in any one calendar year.
(6) 
The applicant shall deposit with the municipality, at the time of the application, a sum in an amount to be set by the resolution of the elected officials of the municipality as a guarantee that all such signs shall be removed promptly within 24 hours after the event referred to on the sign and to which the sign relates. The deposit shall be returned upon the satisfactory removal of such signs within the twenty-four-hour period. If all such signs are not removed at the end of the twenty-four-hour period, the municipality will then have them removed and keep the full sum deposited to reimburse the expenses incurred by the municipality.
g. 
Bunting. Any bunting, pennant or similar material announcing the opening of a new business or industry must be removed 14 days after the opening day or the first day of business. The owner/user of the business or industry shall inform the municipal Zoning Officer in writing of the day of opening or first day of business. Such notice shall be submitted at least 14 days prior to the date of opening or the first day of business.
2. 
TODS Sign along a Township Road. All TODS Signs shall comply with § 1.7 of PennDOT's Traffic Engineering & Operations Manual - Tourist Oriented Directional Signing (TODS) Policy. The Township shall not be responsible for the cost, installation, maintenance, repair, or replacement of any TODS Sign. Any TODS Sign that becomes noncompliant with the PennDOT Manual shall be immediately brought into compliance or removed.
3. 
Permanent Signs. Refer to the requirements of §§ 1105 and 1106.

Off-premises signs may be permitted if the following conditions are met:
a. 
No more than four off-premises signs (permanent or temporary) may be permitted at any one time to identify a farm or agricultural use and/or any products for sale at said farm or use.
b. 
The total area of any such sign shall not exceed 4 1/2 square feet, and the maximum height shall not exceed five feet.
c. 
Such sign shall be placed not more than two miles from the farm or other agricultural use identified by the sign.
d. 
No such sign shall be painted or placed on a utility pole or any natural feature such as a tree or rock. All such signs must be individually and independently supported and shall not be artificially illuminated.
e. 
All such signs shall require sign permits. All applications for an off-premises permanent sign permit shall be accompanied by a document signed by each owner of property on which such off-premises sign would be placed, stating that the property owner has given permission to the applicant to place the sign on the property and stating the place of the sign for which such permission is granted.
f. 
All off-premises signs which identify only the name of the farm or other agricultural use and directional information shall be permitted to remain in place until the farm/use ceases to be used for agricultural purposes. All off-premises signs which identify specific products shall be removed with 10 days of the date on which sales of the advertised product cease.
B. 
Residential Uses - Individual Dwelling Unit.
1. 
Uses: A sign which identifies an individual dwelling unit. Such sign may identify only the property number, street address, post box number and/or the names of the occupants of the residence or the name of the dwelling, estate or farm.

Size: The maximum sign area shall be 24 square feet to identify the complex. This sign area may be increased by one square foot for each establishment and each additional square foot shall be used to identify the individual establishments.

Location Map.

4. 
Individual Establishment Identification Sign.

Number: No more than one sign shall be erected for any establishment unless such establishment has a facade and/or an entrance on more than one street, common parking area, or pedestrian way, in which event, one sign may be erected on each street, common parking area or pedestrian way upon which the individual establishment has a facade and/or an entrance.
b. 
Type: Facia, freestanding, projecting, wall or window.
c. 
Size:
(1) 
Freestanding: 20 square feet maximum.
(2) 
Other. The maximum sign area for the establishment shall be calculated on the length of the facade of the building or length of that portion of such facade which is devoted to such establishment. The sign calculation shall be done separately for each facade and the sign shall be erected on the facade for which it is calculated; the lengths of more than one applicable facade shall not be aggregated for the determination of any one sign.
(a) 
The area of any such sign shall not exceed one square foot for each foot of facade wall length or length of that portion of such wall which is devoted to such establishment. However, no such sign exceed 20 square feet in area.
(b) 
If such establishment does not occupy any floor area on the ground level of building, other than an entryway, the maximum area of such sign per foot of length of the building wall or portion thereof shall be 1/2 square feet. However, no such sign shall exceed eight square feet in area. Such sign shall be placed on the first story of the building.
d. 
Height:
(1)

(2) 
Other: nine feet maximum.
e.

Size: The maximum sign area for the individual establishment shall be calculated on the length of the facade of the building or length of that portion of such facade which is devoted to such establishment. The sign calculation shall be done separately for each facade and the sign shall be erected on the facade for which it was calculated; the lengths of more than one applicable facade shall not be aggregated for the determination of any one sign.
(1) 
The area of any such sign shall not exceed one square foot for each foot of facade wall length or length of that portion of such wall which is devoted to such establishment. However, no such sign shall exceed 20 square feet in area.
(2) 
If such establishment does not occupy any floor area on the ground level of the building, other than an entryway, the maximum area of such sign per foot of length of the building wall or portion thereof shall be 1/2 square foot. However, no such sign shall exceed eight square feet in area. Such signs shall be placed on the first story of the building.

M. 
Outdoor Advertising Sign.
1. 
Such signs shall be located only in the Convenience Commercial Zoning District.
2. 
Any such sign shall stand on land which is leased or purchased for the exclusive business purpose of advertising by sign.
3. 
Only one such sign may be erected per premises fronting on a public right-of-way.
4. 
Yard Setbacks.
a. 
Right-of-Way. No outdoor advertising sign or any part thereof shall be erected or maintained within 50 feet of a future public street right-of-way.
b. 
Side or Rear Yards. No outdoor advertising sign or any part thereof shall be erected or maintained within 50 feet of any side or rear property line.
5. 
No outdoor advertising sign shall be located closer than 500 feet to any other outdoor advertising sign, such measurement to be made from the same side of the road and from the point of location of the two nearest points perpendicular to the right-of-way.
6. 
No outdoor advertising sign shall be located closer than 500 feet to any residentially-zoned land, such measurement to be made from the point of location of the sign to the nearest point of such land along a common right-of-way.
7. 
No outdoor advertising sign shall be placed so as to face a plot on the same street occupied by a church, public school, public park, playground, civic or scenic area, or cemetery within 150 feet in either direction along a common right-of-way.
8. 
No outdoor advertising sign shall be located within 24 feet of any structure.
9. 
The following plant material shall be planted adjacent to outdoor advertising signs:
a. 
Five evergreen trees, five feet to six feet high, within a forty-foot radius on the sides and rear of the base of the sign;
b. 
Four flowering trees, eight feet to 10 feet high, within a 50 foot radius on the sides of the base of the sign;
c. 
One shrub, three feet to four feet high, in front of the sign for every three lineal feet of frontage for a total of no less than 20 shrubs.
10. 
No outdoor advertising sign shall be permitted to exceed a maximum area of 160 square feet, including border and trim but excluding supports. A sign having two sides back-to-back or a V-shaped sign with a horizontal angle not greater than 45° is permitted, 160 square feet on each side or a total maximum area of 320 square feet.
11. 
No outdoor advertising sign or any part thereof shall exceed 20 feet in height measured from the nearest shoulder of the road to the highest point of the proposed sign.
N. 
Electronic Message Center (EMC).
1. 
Electronic Message Centers shall be prohibited in all zoning districts within the Township.

In the historic districts in addition to other requirements, the following regulations must be met prior to the securing of a sign permit:
A. 
A certificate of appropriateness shall be obtained from the local board of historical and architectural review for the use, erection, structural repair, alteration, moving, removal, or demolition of any sign for any use in the historic districts. The applicant shall secure a sign permit under § 1102.C of this Ordinance prior to the application for a certificate of appropriateness.
B. 
A sign shall conform to the regulations of type, location, and duration as indicated in § 1106 for signs for the specific use.

A. 
Any sign legally existing at the time of the passage of this Ordinance that does not conform in use, location, height, or size with the regulations of the district in which such sign is located shall be considered a nonconforming sign and shall be bound by the regulations of this Ordinance regarding nonconforming signs. (See Article XII).
B. 
A sign on a building or structure which does not conform to this Ordinance shall be removed when the building or structure is demolished or when the building or structure renovation or expansion amounts to over 50% of the market value of the building or structure as assessed by the Bucks County Board of Tax Assessment.
C. 
A sign not conforming to this Ordinance shall be removed when the sign requires any structure renovation or the background area of the sign is to be altered, except that nonconforming signs may be repainted as they were without being subject to removal therefore.
D. 
A nonconforming sign must be removed within 14 days after notification by the zoning officer or be made to conform to this Ordinance in every respect whenever:
1. 
It is not attached to the ground or some other object and can be easily moved.
2. 
It becomes so deteriorated that it no longer serves a useful purpose of communication and is a nuisance as determined by the municipality.
E. 
A temporary sign including, but not limited to, such signs as agency signs, agency "open house" signs and special event signs which are erected without a permit, or any non-permitted signs which are "temporary" in nature shall be removed by the zoning officer. All such signs will be retained for a period of 30 days after notification of the offending party after which time the sign be disposed in an appropriate manner.

Violations of the provision of this Article shall be enforced in accordance with Article XVII of this Ordinance.

The following provisions shall apply only to a property which is located along and adjoins the legal right-of-way of the Routes 332-413 Bypass in those areas where access to the Bypass is not limited. A Business Complex Identification Sign is a sign which identifies a single permitted nonresidential use, where only a single use is located on a property, or a permitted group of nonresidential uses. On these properties, a Business Complex Identification Sign may be erected and placed so that the message or symbol of such sign may be seen from a location within the legal rights-of-way of the Bypass. A business complex is one or more institutional, commercial, office, industrial and related uses permitted within the applicable zoning district. A business complex is planned, constructed and managed as a total entity, where parking spaces, stormwater management facilities, access drives, lighting systems, landscaping and other improvements serve the use or uses within the complex.
A. 
A Business Complex Identification Sign may be placed not more than 500 feet from the Bypass legal rights-of-way.
B. 
No more than one such sign shall be placed or erected for a business complex or on a property where a single permitted use is located so that the message or symbol of such sign may be seen from a location within the legal rights-of-way of the Bypass. Under §§ 1106.E.2, 1106.F.2, 1106.G.2, 1106.H.2, 1106.1.2, 1106.J.2 and 1106.K.2, identification signs, whose message or symbol are not seen from a location within the legal right-of-way of the Bypass, may be erected on frontages other than the Bypass frontage.
C. 
A Business Complex Identification Sign shall not be a directory sign and shall identify only the complex or the single permitted use located on a property.
D. 
Such sign shall be erected only on the premises and on the lot where the use it identified is also located.

No freestanding sign shall be placed on a man-made or a natural elevation which is more than five feet above the grade elevation of the Bypass cartway at the sign's closet location to the Bypass.
H. 
Height of a Facia or Wall Sign. A facia or wall sign shall be located on a building no higher than two feet below any roof line.
I. 
Illumination. A Business Complex Identification Sign may be non-illuminated, directly illuminated or indirectly illuminated.
J. 
A Business Complex Identification Sign shall not rotate, flash, revolve, oscillate or display a message or symbol that changes on less than a monthly basis.
K. 
A Business Complex Identification Sign is permitted only as a conditional use under the provisions of § 1304.

On these properties, the message or symbol of such sign may be seen from a location within the legal rights-of-way of the Bypass. A Business Complex is defined in § 1110.
A. 
Such signs shall meet the provisions of this Ordinance related to number, type, size, height, illumination and other requirements for the applicable use.
B. 
Such signs shall be erected so that [they] shall face onto the parking area on the property. The provisions of § 1106.H.4.a. shall not be applicable to a use or establishment that has a facade and/or an entrance on more than one street, common parking area, or pedestrian way. Such use or establishment shall be limited to one sign which shall face onto the primary or largest adjoining parking lot/area within the development.
C. 
A sign permit is required under the provisions of this Ordinance.
