City of Lebanon, PA Article 909 Removal of Wires

§ 909.01 Removal of wires from designated streets.

Pursuant to Third Class City Code Section 2403(50), and in the exercise of its police powers, Council hereby ordains that all persons or bodies, corporate or politic owning, maintaining, or having overhead electric light, telephone or telegraph, television or wires of any other nature upon, along or on the following City streets shall remove the same:

(a) Walton Street, from the east right-of-way line of South Ninth Street to the east right-of-way line of Chapel Street.

(b) Liberty Street, from the south right-of-way line of Spring Street to the north right-of-way line of Walton Street.

(c) South Eighth Street, from the south right-of-way line of Cumberland Street to the north right-of-way line of Walton Street.

(d) Gannon Street, from the south right-of-way line of Cumberland Street to the north right-of-way line of Chestnut Street.

(e) Spring Street, from the east right-of-way line of North Eighth Street to the east right-of-way line of North Seventh Street.

(f) Chapel Street, from the south right-of-way line of Spring Street to the north right-of-way line of Cumberland Street.

(g) Bollman Street, from the south right-of-way line of Cumberland Street to the north right-of-way line of Walton Street.

(h) Seventh Street, from the south right-of-way line of Spring Street to the north right-of-way line of Walton Street.

(i) The eastern one-half of North Eighth Street, from the south right-of-way line of Willow Street to the north right-of-way line of Cumberland Street.

(j) Liberty Street, from the south right-of-way line of Willow Street to the north right-of-way line of Spring Street.

§ 909.02 Completion date.

(a) The removal of wires in Section 909.01(a) to (d) shall be fully completed by such person or bodies within one year of the effective date of Ordinance 59-1966, 67.

(b) The removal of wires in Section 909.01(e) to (j) shall be fully completed by such person or bodies within one year of the effective date of Ordinance 36-1968, 69.

§ 909.03 Replacement of wires.

Such wires shall either be placed in underground conduits within such streets at such place and in such manner as shall be approved by the Bureau of Engineering of the City, or be placed within other locations not prohibited by this article.

§ 909.99 Penalty.

Failure to comply with the provisions of this article shall subject the person or body to a penalty not to exceed $300 and/or imprisonment not exceeding 10 days, each day that such wires are maintained beyond the one-year period constituting a separate and distinct offense for which a like penalty shall be imposed.
