The purpose of this policy is to foster the health and safety of all employees and visitors while conducting City business.

(a) 
The intent of this policy is to prohibit smoking at the following City facilities with the exception of one designated smoking area at each location:
Municipal Building, 400 South Eighth Street, Lebanon:
Cafeteria Smoking Room
City Maintenance Garage, Tenth and Oak Streets, Lebanon:
Locker Room
Wastewater Treatment Plant, 250 Dairy Road, Lebanon:
Belt Filter Press Room
Water Maintenance Shop, 2200 Chestnut Street, Lebanon:
Lunch Room; and
Water Treatment Plant, Grace Avenue and Behney Street, Lebanon:
Superintendent's Office.
(b) 
Visitors, customers, consultants and the like will be asked to observe the City smoking policy on City properties located outside the City. Any person refusing to do so after one warning is deemed to have lost his/her authority to be on City property and shall be in defiant trespass.

Smoking is totally prohibited at the following locations:
Fire company sleeping quarters;
Gingrich Pool in Coleman Memorial Park; and
Stoever's Dam Nature Barn.

Smoking shall be permitted in the designated smoking area at the facilities set forth in Section 1107.02 only during the fifteen-minute morning and afternoon break times and during the lunch break.

Smoking shall be permitted in fire company meeting rooms and in fire company kitchens at the discretion of each House Committee.

Smoking shall be permitted in City-owned vehicles at any time, provided all passengers are in agreement. If all passengers are not in agreement, the preferences of the nonsmoker(s) shall prevail.

(a) 
Enforcement of this policy among City employees shall be the responsibility of supervisors and department heads.
(b) 
Employees violating any of the provisions of this article shall be subject to the following procedure and may be subject to the provisions of Section 1107.99.
(1) 
An offended employee shall first notify the offending employee's supervisor or department head. If the offending employee is a supervisor or department head, the offended employee shall notify the Mayor.
(2) 
First Offense. The immediate supervisor or department head shall give a verbal warning to the employee.
(3) 
Second Offense. The immediate supervisor or department head shall notify the Mayor, who may give written warning to the employee.
(4) 
Third Offense. The Mayor may suspend the employee for one day without pay.
(5) 
Subsequent Offense. The Mayor shall determine any further discipline, which may include dismissal.

Persons who wish to make a complaint against nonemployees regarding a violation of this policy shall contact a City supervisor or department head, who shall in turn refer the complaint to the Mayor.

The sale of tobacco products on City-owned property is expressly forbidden.

Department Heads shall be responsible for the posting of "no smoking" signs in their departments and departmental facilities in accordance with the provisions of this policy.

Any person violating any of the provisions of this article shall be fined not less than $50 or more than $300 and/or be imprisoned for not more than 90 days.
