There shall be provided at the time of erection or enlargement
of any principal building or structure the following minimum off-street
parking spaces, with adequate provision for ingress and egress:
A.
Dwelling units: one parking space for the first occupant age 18 or
older, plus one additional parking space for each additional occupant
age 18 or older not related by blood or marriage to the first occupant.
B.
Restaurants, bars, and cocktail lounges: one space for every 150
square feet of floor area.
C.
Motor vehicle service station or repair garage: three spaces for
every service bay, plus two spaces.
D.
Auditorium, theater, stadium, and similar place of assembly: one
space for every five seats provided.
E.
Hospitals, nursing homes and personal care centers: one space for
each five beds.
F.
Hotel, motel or bed-and-breakfast use: one space for every two rental
units, plus spaces needed to serve any related use, such as a restaurant
open to the public.
G.
Clubs or lodges: one space for each 400 square feet of floor space.
H.
Lodging houses and boardinghouses: one parking space per occupant
age 18 or older not related by blood or marriage.
I.
Car wash: adequate waiting spaces and spaces for vacuuming, in addition
to one space per two washing bays.
J.
Commercial buildings not otherwise listed: one space for each 250
square feet of floor space.
K.
Industrial buildings: one space for every two employees in the largest
working shift.
L.
Offices: one space for each two employees working on the premises.
M.
Bowling alleys: three spaces for each alley.
N.
Service and repair establishments (other than motor vehicle service
stations and repairs), such as laboratories, business and vocational
schools, or veterinary establishments: one space for each 600 square
feet of total floor area.
O.
Funeral homes.
(1)
Where a chapel is included as part of the funeral establishment,
one parking space for each five seats in the chapel shall be provided.
(2)
Where no chapel is included, one parking space for every 150 square
feet of floor area in the funeral home shall be provided.
(3)
In either case, sufficient off-street driveway space shall be provided
to permit the assembly of funeral processions of anticipated length.
P.
Other uses. In the case of any use or building which is not specifically
mentioned above, the provisions for a use or building mentioned most
similar shall apply, unless the applicant proves to the satisfaction
of the Zoning Administrator that an alternative standard is justified.
A.
Existing parking. Structures and uses in existence at the effective
date of this chapter shall not be subject to the requirements of this
article so long as the kind or extent of use is not changed, provided
that any parking facility now serving such structures or uses shall
not in the future be reduced below such requirement.
B.
Location and condition of parking.
(1)
Front yard. All new vehicle parking spaces shall be located outside
of the required minimum front yard. On a corner lot, such restriction
shall only apply adjacent to the more heavily traveled street, as
determined by the Zoning Administrator.
(2)
Off site. Required off-street parking spaces shall be located on
the same lot where the principal buildings or structures are located,
except as follows, through a long-term lease or other suitable arrangement:
(a)
Required parking spaces serving residential uses may be placed
up to 200 feet from the lot containing the residential uses;
(b)
Required parking spaces serving nonresidential uses may be placed
up to 400 feet from the lot containing such uses; and
(c)
Required parking spaces serving nonresidential uses in the TC
Town Center District may be located up to 800 feet from the lot containing
the uses.
(3)
Surface connection to street.
(a)
All parking areas and driveways shall be surfaced with a dustless
and durable material and shall be graded to prevent the accumulation
of surface water. If there are more than five parking spaces on a
lot, all of the parking spaces shall be paved in asphalt, concrete
or paving block.
(b)
The first 10 feet of length of a driveway measured from a street
right-of-way shall be paved in asphalt, concrete or paving block.
Asphalt shall not be placed over a concrete sidewalk. The connection
of the driveway to the cartway of a street shall be in asphalt or
concrete with the curb cut meeting the construction standards of the
Allegany County Department of Public Works.
(c)
The street entrance at the curb cut shall be at least 12 feet
in width and shall be well marked by clearly visible pavement marking
(red paint required by the Town). The marking shall extend one foot
beyond each edge of the curb cut (12 feet of entrance/curb cut equals
14 feet of red stripe).
C.
Conflict with other uses. No parking area shall be used for any other
use that interferes with its availability for the parking need it
is required to serve.
D.
Continuing character of obligation. All required parking facilities
should be provided and maintained so long as the use that the facilities
were designed to serve still exists. Off-street parking facilities
shall not be reduced in total extent except when such reduction is
in conformity with the requirements of this article in conjunction
with a change in the nature of the use.
E.
Joint use.
(1)
Two or more uses may provide for required parking in a common parking lot; the total number of spaces in such lot shall not be less than the sum of the spaces required for each use individually, unless such lot is provided as specified in Subsection E(2) as follows.
(2)
Up to 50% of the parking spaces required for (a) theaters, auditoriums,
bowling alleys, or private clubs, and up to 100% of the parking spaces
required for churches or meeting halls, may be provided collectively
and used jointly by (b) banks, offices, retail stores, repair shops,
service establishments and similar uses not normally open, used or
operated during the same hours as those listed in (a); provided, however,
that a written agreement assuring the continued availability of such
parking areas shall be properly drawn and executed by the parties
concerned, approved as to legal sufficiency by the Town Attorney,
and filed with the application for the zoning permit.
F.
Mixed uses. Where a permitted use contains or includes more than
one of the types of uses identified in this article, the number of
parking spaces required shall be the sum of the computed requirements
for the separate types of uses.[1]
G.
Fractional spaces. Where the computation of required parking spaces
results in a fractional number, only the fraction of 1/2 or more shall
be counted as one.
The design standards specified in this section shall be required
for all new off-street parking facilities with a capacity of four
or more vehicles. Such facilities shall be designed so that their
use shall not constitute a nuisance or hazard or unreasonable impediment
to traffic.

B.
Parking areas shall be designed so that each motor vehicle may proceed
to and from the parking space provided for it without requiring the
moving of any other motor vehicle.
D.
No parking areas shall be designed to require or encourage parked
vehicles to back into a public street in order to leave the lot.
E.
Except for areas that are landscaped and so maintained, all portions
of required parking facilities, including driveways, shall be graded,
surfaced with asphalt or other suitable material, and drained to the
extent necessary to prevent dust, erosion, or excessive water flow
across streets or adjoining properties.
F.
All lighting fixtures used to illuminate parking areas shall be arranged
to prevent glare into public streets and adjoining properties.
G.
Except where entrance and exit drives cross street lines, all parking
areas for any purpose other than single-family residences shall be
physically separated from any public street by a concrete curb and
by a planting strip which shall be not less than 10 feet in depth.
This ten-foot planting strip shall be parallel to the street line
and shall be measured from the future right-of-way.
To comply with § 4-104 of the Land Use Article of
the Annotated Code of Maryland, any new use required to supply 10
or more new off-street parking spaces shall include a suitable area
for the parking of bicycles. Such area should allow for the locking
of bicycles to a secure feature but shall not result in obstructions
to fire exits or handicapped accesses.
A.
Number of spaces. Any lot including four or more off-street parking
spaces shall include a minimum of one handicapped space. The following
number of handicapped spaces shall be provided, unless a revised regulation
is officially established under the federal Americans with Disabilities
Act:

B.
Location. Handicapped spaces shall be located where they would result
in the shortest reasonable accessible distance to a handicapped accessible
building entrance.
C.
Minimum size. Each required space shall be eight feet by 18 feet.
In addition each space shall be adjacent to a five-foot-wide access
aisle. Such access aisle may be shared by two handicapped spaces.
D.
Slope. Handicapped spaces shall be located in areas less than 6%
slope in any direction.
E.
Marking. All required handicapped spaces shall be well marked by
clearly visible signs or pavement marking (blue paint required by
the Town).
F.
Paving. Handicapped spaces and adjacent areas needed to be accessed
shall be covered with a smooth surface accessible by a wheelchair.
A.
Off-street truck loading berths shall be provided as an accessory
to any use specified in the following subsections:
(1)
For a public library, museum, or similar quasi-public institution
or governmental building, community center, hospital or sanitarium,
nursing or convalescent home, institution for children or the aged,
school, professional, governmental, or business offices, or laboratory
establishments, with a gross floor area between 10,000 and 25,000
square feet, one berth shall be provided, plus one additional berth
for each additional 25,000 square feet or fraction thereof.[1]
(2)
For buildings with offices and retail sales and service establishments,
with a gross floor area between 8,000 and 25,000 square feet, one
berth shall be provided, plus one additional berth for each additional
25,000 square feet or fraction thereof.
(3)
For manufacturing, wholesale and storage uses and for dry-cleaning
and rug cleaning establishments and laundries, with a gross floor
area between 5,000 and 10,000 square feet, one berth shall be provided,
plus one additional berth for each additional 20,000 square feet or
fraction thereof.
B.
Each required off-street truck loading berth shall be at least 55
feet long, measured perpendicular to the loading dock, shall be at
least 14 feet wide, and shall provide a minimum overhead clearance
of 16 feet.
C.
Each required off-street truck loading berth shall have unobstructed
access to a public street. Such access may be combined with access
to an off-street parking lot; provided, however, that all berths shall
be designed so that maneuvering of trucks to reach the loading dock
shall not require the use of any required off-street parking spaces
or intrude into any street right-of-way. No off-street loading berth
shall be located in any required front yard.
D.
All permitted or required loading berths shall be on the same lot
as the use to which they are accessory, except that berths may be
provided in spaces designed to serve jointly two or more adjacent
establishments, provided that the number of berths in such joint facilities
shall not be less than the total required separately for all such
establishments.
