It shall be unlawful for any minor under the age of 16 years to loiter or be in or upon the public streets, roads, sidewalks, alleys, public places, vacant lots or other unsupervised places of the Town of Westernport, Maryland, between the hours of 10:30 p.m. and 5:00 a.m. of the following day; provided, however, that the provisions of this section shall not apply to such minor who is accompanied by his or her parent, guardian or other adult person having the care and custody of the minor or when the minor is upon some necessary errand by permission or direction of his or her parent, guardian or other adult person having the care and custody of the minor, which permission shall be in possession of said minor and be signed by the parent, guardian or other adult person having the care and custody of the minor.
It shall be the duty of the bailiff or other police officer of the Town of Westernport to immediately apprehend and take into custody any minor violating the provisions of this article and forthwith deliver said minor to his or her parents or guardian or other person charged with the care and custody of said minor, or said officer shall forthwith notify them of the apprehension of said minor, whereupon said minor shall be released by said officer to the custody of said parent or other person charged with the minor's care, and should said minor again be taken into custody for a violation of this article, then the Mayor and Commissioners of Westernport or the Mayor or any individual Commissioner may prefer and file formal complaint before the Juvenile Magistrate for Allegany County, Maryland, charging said minor with delinquency and likewise charging the parent of said minor or whosoever has charge of said minor with contributing to said delinquency.
The Mayor and Commissioners may, upon request of the public or parochial schools, any church, or organized recreational group, designate any night upon which the provisions of §§ 130-1 and 130-2 will not be effective as to children under the age of 16 years who may be in attendance at any activity held by such school, church or organized recreational group; provided, however, that the application must be made to the Mayor and Commissioners through the Town Clerk at least 48 hours before such event is to be held, and provided further that minors attending such event will be allowed only a reasonable time after the expiration of such event to reach their homes.
