This chapter shall be known as the "Town of Verona Junk Storage Law."
By adoption of this chapter, the Town of Verona declares its intent to regulate and control the storage or keeping of junk and to regulate junkyards whether operated for commercial profit or otherwise. The Town Board hereby declares that a clean, wholesome and attractive environment is of vital importance to the continued general health, safety and welfare of its citizens and that junk and junkyards can constitute a hazard to property and persons and be a public nuisance. Such material may be highly flammable and sometimes explosive. Junk, and particularly junked vehicles, can constitute attractive nuisances to children and certain adults. The presence of junk and junkyards is unsightly and tends to detract from value of surrounding properties unless properly screened from view.
This chapter is adopted pursuant to the authority granted the Town in § 10 of the Municipal Home Rule Law and in § 130, Subdivision 15, of the Town Law.
For the purpose of this chapter, the following words and phrases shall have the meaning ascribed to them in this chapter.
ENFORCEMENT OFFICER
Any person appointed and empowered by the Town Board to represent them in particular matters pertaining to this chapter.
JUNK
The outdoor storage or deposit of any of the following shall constitute junk:
A. 
Two or more junk vehicles as further described herein.
B. 
One or more abandoned mobile homes or trailers (as defined in Chapter 171, Manufactured Homes) or one or more abandoned all-terrain vehicles or snowmobiles (as defined in the New York State Vehicle and Traffic Law).
C. 
Two or more inoperable appliances, including but not limited to lawn and garden machines, washers, dryers, dishwashers, stoves, refrigerators, freezers and televisions, including household furnishings.
D. 
Two or more inoperable pieces of equipment.
E. 
Collection and storage of any secondhand or used material which, taken together, equals in bulk volume 500 cubic feet or more.
F. 
Any combination of the above, or parts of the above, that total two or more items.
JUNK STORAGE AREA
The area of any parcel of land intended to be used for the placement or storage of junkyard items.
JUNK VEHICLES
A. 
Any motor vehicle whether automobile, bus, trailer, truck, tractor, motor home, motorcycle, minibicycle or snowmobile, or any other device originally intended for travel on the public highways which meets all of the following conditions:
(1) 
It is unregistered.
(2) 
It is either abandoned, wrecked, stored, discarded, dismantled or partly dismantled.
(3) 
It is not in proper condition for legal use upon the public highway.
B. 
With respect to any motor vehicle not required to be licensed or motor vehicle not usually used on public highways, the fact that such motor vehicle has remained unused for more than six months and is not in condition to be removed under its own power shall be presumptive evidence that such motor vehicle is a junk vehicle.
JUNKYARD
A. 
The outdoor storage or deposit of any of the following:
(1) 
Five or more junk vehicles as further defined herein.
(2) 
Two or more abandoned mobile homes or trailers (as defined in Chapter 171, Manufactured Homes) or two or more abandoned all-terrain vehicles or snowmobiles (as defined in the New York State Vehicle and Traffic Law).
(3) 
Five or more inoperable appliances, including but not limited to lawn and garden machines, washers, dryers, dishwashers, stoves, refrigerators, freezers and televisions, including household furnishings.
(4) 
Five or more inoperable pieces of equipment.
(5) 
Collection and storage of any secondhand or used material which, taken together, equal in bulk volume 2,000 cubic feet or more.
(6) 
Any combination of the above that totals five items.
B. 
Nothing herein contained shall be deemed to prevent farmers, loggers or contractors from storing and/or maintaining on their own premises, motor vehicles, machinery and equipment now used by them in their business. Also nothing herein contained shall be deemed to prevent the conduct of a New York State licensed new and/or used car business or a bona fide garage business and the parking of not to exceed 10 vehicles in the process of or waiting for repairs.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
