The following words, when used in this Part, shall have the
following meanings, unless the context clearly indicates a different
meaning:
CHAINS
Full chains, strap chains or other types of chains mounted
on both rear wheels of a motorized vehicle.
PRIMARY SNOW EMERGENCY ROUTE
Designated streets, as defined in §
15-605 of this Part, which are primary transportation routes through the Borough and are considered to be essential to the rapid movement of emergency vehicles and normally carry the heaviest traffic volume or represent a significant physical hazard during times of snow.
SNOW
Any precipitation depositing snow, sleet, hail, ice and freezing
rain on streets within the Borough.
SNOW REMOVAL CONDITION
A snow removal condition is hereby declared to exist in the
Borough whenever one of the following exists:
A.
Accumulation to a depth of three inches or more; when this condition
exists due to depth of accumulation, no action by the Mayor or Borough
official is necessary to implement the conditions of this Part.
B.
When, in the opinion of the Mayor or such person designated
by the Mayor, the street conditions are hazardous and dangerous to
vehicular and pedestrian traffic because of snow accumulation.
SNOW TIRES
Tires having treads designed for use in snow, which tires
must be in such condition as to serve the purpose for which they are
designed.
VEHICLE
Any self-propelled motorized vehicle licensed to travel upon
the streets, roads and highways of the Borough.

In the event of a snow removal condition, said condition shall
occur immediately, and notice shall immediately be issued to local
radio and news services. In either instance, a snow removal condition
is presumed to continue for a period of 24 hours following the accumulation
of snow or until such other period of time as designated by the Mayor.

In the event of a snow removal condition, parking will be permitted on the streets with the same conditions as stated in §
15-307, "Alternate Parking Established on Certain Streets."

During such time as a snow removal condition is in effect or
alternate side parking as a result of a snow removal condition, it
shall be a violation of this Part for any person, firm, organization
or entity to park, abandon or leave unattended any vehicle on any
streets, roads, highways or any specified side of the street and municipal
parking lots and their adjacent rights-of-way within the boundaries
of the Borough that have been publicly designated for snow removal
or plowing.

During the period of November 1 to May 1, the primary snow route
shall be identified by signage consistent with approved traffic markings
and shall provide notice to the public of the right of the Borough
to remove cars which are left unattended during a period of snow emergency.
Secondary snow routes or other provisions of a Mayor's proclamation
shall be noticed by notifying news sources and temporarily marking
roads when appropriate and feasible.

During such time as a snow removal condition is in effect, any person, firm, organization or entity operating or causing to be operated a vehicle which is not equipped with appropriate tires for winter conditions or chains upon any street, road or highway within the boundaries of the Borough resulting in such vehicle becoming stalled or incapable of moving under its own power, or who leaves such vehicle abandoned or unattended on any street, road or highway within the boundaries of the Borough as a result of its inability to move under its own power because of its failure to be equipped with snow tires or chains, shall be in violation of this Part
6 and shall be subject to the penalties and fines set forth in §
15-608.

1. During such time as a snow removal condition is in effect, any person who shall park a vehicle anywhere upon or along any of the streets of the Borough that have been publicly designated for snow removal or plowing shall be guilty of a violation of this Part
6 and, upon conviction thereof, shall be sentenced to pay a fine of $100 if paid within seven days.

A. If not paid within seven days of the date on the ticket, the fine
will be increased to $150.
B. If payment is not made within 14 days of the date on the ticket,
prosecution will be initiated, and the fine will be increased to $175.
2. Any person who shall operate a vehicle upon the streets of the Borough, if such vehicle shall become stalled during such time as a snow removal condition is in effect, and if such stalling shall have been by reason of the failure to have such vehicle equipped as prescribed in §
15-607 of this Part, shall be guilty of a violation of this Part, and, upon conviction thereof, such person shall be sentenced to pay a fine of $25 together with costs of prosecution.
