The purpose of this article shall be to generate revenue to
pay all long- and short-run costs for operation and maintenance for
the entire facilities of the Village of Woodridge and pay for debt
service and capital expenditures.

Each user of the Village facilities shall pay a water operation and maintenance charge. The water operation and maintenance charge will be levied annually and collected quarterly. The amount levied and collected will be the amount the Village is obligated to pay for operation and maintenance of the entire water facilities of the Village of Woodridge. The amount levied shall be distributed to all users of the water system in proportion to the contribution of all users as set forth in § 387-32.
A.
Distribution of the water operation and maintenance charge shall
be achieved by apportioning the total water operation and maintenance
costs among all users in proportion to the user's water consumption
to the total water consumption of all users of the Village facilities.
B.
A minimum operation and maintenance charge shall be levied to all
users of the Village facilities calculated as the total operation
maintenance and fixed costs divided by the total water consumption
of all users of the Village facilities multiplied by the average user
water consumption.

Discounted charges based on large volumes shall not be permitted.

Each owner of real property located within the incorporated limits of the Village of Woodridge shall pay a water capital charge. In addition, each owner of real property located outside the incorporated limits of the Village of Woodridge which is connected to and benefits from the Village waterworks shall pay a water capital charge. The water capital charge will be levied annually and collected quarterly. The amount levied and collected will be the amount the Village is obligated to pay for principal and interest on its outstanding water serial bonds and/or bond anticipation notes (BAN's). The amount levied shall be distributed to all owners of real property located within the incorporated limits of the Village of Woodridge in proportion to the relative benefits derived therefrom. This distribution shall be derived by apportioning the total water capital charge costs among all owners of real property located within the incorporated Village of Woodridge, as well as all users of the Village water facility located outside the incorporated Village of Woodridge, as set forth in § 387-32.
Distribution of the water capital charge shall be achieved by
apportioning the total amount the Village is obligated to pay for
principal and interest on its outstanding water serial bonds and/or
BAN's between all users in accordance with the following capital
unit allocations:

The user charge system, the user classes and the total cost
of operation and maintenance of the water facilities shall be rereviewed
no more often than biannually, and any necessary revisions shall be
made in the charges for users or user classes to maintain the proportional
distribution of operating and maintenance costs among users and user
classes to generate sufficient revenue to pay the total operation
and maintenance costs necessary to the proper operation and maintenance
and to apply excess revenues collected from a class of users to the
cost of operation and maintenance attributable to that class for the
next year, and the rate shall be adjusted accordingly.
Bills for water service shall contain a minimum of two line
items:

Water operation and maintenance charges and/or water capital
charges which are not paid on or before the due date shall bear a
penalty of 2% per month or 24% per annum, compounded monthly. If such
amount remains unpaid on the first day of July, the Village Clerk-Treasurer
shall certify the amount due and payable to the Board of Trustees,
who shall levy the same as taxes and add such water operation and
maintenance charge and/or water capital charge and penalties to the
succeeding tax roll of the Village. Such tax shall be collected and
enforced in the same manner and at the same time as provided for the
collection and enforcement of Village taxes. Such water operation
and maintenance charge and/or water capital charge shall constitute
a lien upon the real property served by such waterworks, and such
lien shall be prior and superior to any other lien or claim except
the lien of an existing tax, assessment or other lawful charges.
All water service may be discontinued if the water operation and maintenance charge and/or water capital charge for such services are not paid within 90 days after rendition of the bill therefor. Such termination will be in accordance with § 387-25 of this chapter.
A.
All owners of real property located within the incorporated limits
of the Village of Woodridge, as well as all customers outside the
incorporated limits of the Village of Woodridge, who are connected
to and benefit from the Village of Woodridge water facilities must
pay water capital charges.
B.
All users of the water facilities of the Village of Woodridge must
pay water operation and maintenance charges.
