It is the policy of the Forest Hills Borough that the Borough
owned recreation facilities and parks shall be kept for the healthful
and varied amusement and recreation of the residents of the Borough
on a year-round basis, as a means of promoting the general health
and welfare. Use to the maximum intensity is to be encouraged, subject
to requirements of health, safety and security of property in the
parks. This policy shall apply to all parks and recreation facilities
now owned by the Borough, as well as those hereafter acquired; provided,
that nothing set forth herein is intended to be in conflict with or
inconsistent with the requirement of any federal or state regulation
appurtenant to use of any facility acquired or developed with federal
or state funds as relates to the use of such facility.

The parks presently owned by the Forest Hills Borough are:
A.
Forest Hills Borough Park - located on Ardmore Boulevard and Braddock
Road. In this park is located the Forest Hills Recreation Center,
which consists of the lodge, swimming pool and appurtenant areas within
the enclosure fence.
B.
Forest Woodland Park - on Avenue "L."
C.
Koch Park - at the north end of Atlantic Avenue.
D.
Bright Park - on Morrow and Sherwood Roads.
E.
Ryan Glen Park - on Cascade Road at its intersection with Batavia
Road.
F.
Cliffwood Park - on Marwood Road.
G.
Forest Hills/Westinghouse Recreation Center - on Barkley Avenue.

These are sometimes collectively referred to in this Part as the
"park system" or as the "parks," which also includes any additional
park hereinafter acquired by the Borough.

The Forest Hills Borough Recreation Board, established by Ord. 472, approved March 9, 1966 [§ 1-302], is empowered to promulgate suitable regulations not inconsistent with the provisions of this Part for the governance, operation and use of the parks, including the imposition of reasonable user fees and security deposits.

1.
The following acts done within the limits of any of the public parks
of the Forest Hills Borough are hereby declared to be unlawful and
Borough police officers shall have the power to remove any individual
from a Borough park or recreation facility for violation of Borough
ordinances and posted park regulations or for performing any of the
acts listed here:
A.
To injure, deface or destroy any posted notice, rules or regulations
relating to the use of such park.
B.
To cut, injure, remove, deface or destroy any wood, turf, grass,
tree, soil, rock, sand or gravel therein or any shelter house, building,
structure, plumbing or electrical equipment or fireplace therein.
C.
To make or kindle a fire therein for any purpose excepting in the
fireplaces provided therefor.
D.
To indulge in riotous, boisterous, threatening or indecent conduct
or to use abusive, threatening, profane or indecent language therein.
E.
To sell, expose or offer for sale any merchandise, article or thing
whatsoever without first obtaining a written permit therefor from
the Manager.
F.
To lead, ride, let loose or permit to run at large any animal or
fowl.
G.
To ride, drive or propel any powered vehicle on a foot path, or on
any other part of such park, except on roadways or parking lots therein.
H.
To ride or drive any powered vehicle at a speed in excess of 15 miles
per hour.
I.
To possess, use, carry or discharge any fireworks or explosives.

J.
To carry, transport or consume any malt, spirituous or vinous beverages
whatsoever within the limits of such park, or to remain while under
the influence of the same, provided that, subject to the regulations
of the Recreation Board, the use of such beverages in the Lodge in
the Forest Hills Borough Park is permitted.
K.
To deposit, drop or cast out any trash, litter, rubbish, garbage
or debris, except to place the same within a rubbish or trash container
provided for such purpose.
L.
To refuse to obey the posted rules and regulations governing personal
conduct and actions at the municipal swimming pool.
M.
To enter any enclosed or fenced facility within the public parks,
such as buildings, swimming pool, or tennis courts without permission
from authorized Borough personnel.
N.
To carry a lighted cigar, cigarette, pipe or other lighted smoking
device.
O.
To unlawfully possess, use, carry or discharge any firearms.
P.
Purposefully, intentionally or knowingly feeding, causing deer to
be fed, or providing food to deer, including but not limited to disbursement
of food on the ground, at a feeding station, a feeding device, or
in a container of any form; providing salt or mineral lick/block;
or any other means which serves to provide feed or results in the
attraction of any deer, unless permitted under § 42-401.

It shall be unlawful for any group, company, society or organization
whatsoever to hold any picnic, celebration, parade, service or exercise
whatsoever in the public parks of the Forest Hills Borough without
first having obtained a permit in writing from the Borough Manager.
Such permit shall be applied for by a bona fide member of such group,
company, society or organization who is also a resident of the Forest
Hills Borough.

It shall be unlawful for any persons to possess, use, carry or discharge
archery equipment in the public parks of the Forest Hills Borough
or on any Borough-owned property without first having obtained a permit
in writing from the Borough Chief of Police. Such permit shall be
issued only to a resident or employee of the Forest Hills Borough
for purposes of a controlled deer hunt. Any archery hunting shall
be pursuant to rules and regulations established by the Borough Council
and implemented by the Borough Chief of Police. Any violation of this
section or the rules and regulations promulgated thereunder could
result in a revocation of permit.

The public parks, with the exception of the recreation center
and swimming pool, shall be closed every night at dusk, prevailing
time, and shall remain closed until dawn, prevailing time, of the
following day. The road leading to the recreation center and swimming
pool shall also be closed at dusk, prevailing time, except on those
nights when authorized events or activities are taking place at the
recreation center. During the closed period it shall be unlawful for
any person, not having official business therein, to be within the
territorial limits of said parks. Dusk is defined as that time of
day immediately following sunset. Dawn is defined as that time of
day immediately following sunrise. Any officer of the Borough's Police
Department shall have the power to close any Borough park or recreation
facility for violation of Borough ordinances and posted park regulations
or public safety concerns when circumstances in the discretion of
an officer on duty or acting in an official capacity merits such an
adjustment.

The Recreation Board is hereby authorized to promulgate rules and regulations for conduct to be enforced on the premises of the recreation center and swimming pool; said rules and regulations to be subject to ratification by resolution of Council approved by the Mayor. The Borough Secretary shall enforce said rules and regulations and may delegate to the recreation center manager all responsibilities in relation thereto. Any person or persons violating the posted rules and regulations at the swimming pool shall be subject to immediate dismissal from the grounds and the loss of swimming privileges without refund of money for the remainder of the season. Violation of the rules and regulations above provided for shall constitute a violation of this Part. In the discretion of the Secretary, the penalty provided for in this section may be an alternative to or in addition to the penalty provided for in § 16-108 of this Part.

All playgrounds, playfields, basketball courts and other recreational
centers which have been or hereafter may be established by the Forest
Hills Borough are intended for the use and enjoyment of Borough residents
and organizations and, unless written permission is obtained from
the Manager or his designated representative or where specific user
regulations have been established, nonresidents shall not be permitted
to use such facilities. Provided, further, Borough parks and recreational
facilities shall not be used for-profit purposes unless a permit is
obtained from the Borough Manager or his designee.

The Borough Council may establish, by resolution adopted from
time to time, a schedule of fees as shall be necessary for the use
and/or rental of Borough park and recreation facilities.

Any person, firm or corporation who violates a provision of this Part, or who fails to comply therewith, or with any of the requirements thereof, shall be, upon conviction thereof, sentenced to pay a fine of not less than $100 nor more than $1,000 for each violation, plus costs, and in default of payment of said fine and costs, to imprisonment to the extent permitted by law for the punishment of summary offenses. Procedures for collection of fines and penalties for default of payment shall be in accordance with Chapter 1 of this Code.
2.
A separate offense shall arise for each day or portion thereof in
which a violation is found to exist or for each section of this Part
found to have been violated. All fines and penalties for the violation
of this Part shall be paid to the Borough Treasurer.
3.
The Borough may also commence appropriate actions in equity or other
to prevent, restrain, correct, enjoin, or abate violations of this
Part.
