The Village Board of the Village of Woodridge has determined
that the burning of trash and other waste products outside or in commercial
or residential structures deprives neighboring residences of the enjoyment
of their property and/or use of their premises, requiring them to
keep their windows closed to avoid noxious odors and possible smoke
or fumes from the burning substances. In addition, the use of outdoor
wood-burning boilers, which may provide an economical alternative
to conventional heating systems, may be a viable alternative in more
rural areas but is inappropriate for use in more densely populated
areas such as the Village of Woodridge. As such, the Village of Woodridge
will impose reasonable limits to reduce the danger to the health,
safety, comfort and general welfare of the residents and inhabitants
of the Village of Woodridge.
The burning of garbage, trash and other waste products within
the Village of Woodridge, whether indoors or outdoors, is hereby prohibited.
No person, firm, or corporation shall cause, allow, install
or maintain the use of an outdoor wood-burning boiler within the Village
of Woodridge.
A.
Any person, firm or corporation violating any provision of this chapter
shall be fined not less than $100 nor more than $500 for each offense,
and a separate offense shall be deemed committed on each day during
or on which a violation occurs or continues to exist.
B.
A violation of this chapter is hereby deemed to be a nuisance, and
in addition to any other relief provided herein, the Village Attorney
may apply to a court of competent jurisdiction for an injunction to
prohibit the continuance of any violation of this chapter. Such application
for relief may include a temporary restraining order, temporary injunction,
permanent injunction, and reasonable attorneys' fees.
