As used in this chapter, the following terms shall have the meanings indicated:
CARNIVALS, CIRCUSES, TRAVELING SHOWS, FIESTAS and FESTIVALS
Any temporary or traveling shows or exhibits held in any building, tent, enclosure or on any lot where the following forms of amusement or entertainment are or may be conducted: riding devices, such as Ferris wheels, merry-go-rounds, carousels, whips, roller coasters or similar devices; illusion shows; animal acts; trapeze acts; feats of daring; clowns; mechanical shows; freak shows; sideshows; funhouses; or active games of skill, such as ball-throwing games, pitch-till-you-win games, swinging-ball games, hoop-throwing games or games of like character.
WEEK
Seven consecutive days or less, including Sundays and legal holidays.
A. 
No person shall hold or conduct a carnival, circus, traveling show, festival, fiesta or exhibit in the Village of Woodridge unless such person shall first obtain a permit from the Village of Woodridge.
B. 
No permit shall be issued by the Village of Woodridge to any person to conduct a carnival, circus, traveling show, exhibit, festival or a fiesta unless the applicant first shall:
(1) 
Furnish the Village of Woodridge with information, in writing, as to the proposed date and place of the carnival, circus, traveling show, exhibit, festival or fiesta; the organization, society or club, if any, for whose benefit the carnival, circus, traveling show, exhibit, festival or fiesta is to be held; the nature of the structures and the devices to be used; the nature of entertainment to be given or permitted; and the location, by Tax Map parcel number, of the place where the carnival, circus, traveling show, exhibit, fiesta or festival is to be held.
(2) 
Pay a permit fee to the Village of Woodridge, in advance. The fee(s) shall be set by resolution of the Board of Trustees from time to time.[1] The current fee schedule is available at the Village Clerk's office.

A. 
Any person permitted to conduct a carnival, circus, traveling show, exhibit, fiesta or festival in the Village of Woodridge shall, as a condition to retention of his/her permit:
(1) 
Close the carnival, circus, traveling show, exhibit, fiesta or festival not later than 12:00 midnight.
(2) 
Comply with all the requirements of all Village of Woodridge codes and ordinances and the statutes of the State of New York.
(3) 
Take all necessary action which is required to prevent the use of loud or noisy devices or activities or the occurrence of any disorderly conduct by patrons or employees of the permittee.
B. 
Failure of the permittee to comply with all parts of Subsection A above or violation by the permittee of any part of Subsection A above shall result in immediate revocation of the permit previously issued.
Each permittee, as a condition for the issuance of any permit, shall first supply the Village of Woodridge with a valid, prepaid policy of liability insurance, insuring the permittee and the Village of Woodridge from bodily injury liability, including death, in an aggregate amount of $5,000,000 and property damage liability in an aggregate amount of $5,000,000.
The applicant shall post with the Village a performance bond with a surety company approved by the Village in the amount of $10,000. The condition of such bond shall be that the applicant shall at all times follow and comply with all the Village's ordinances and regulations. Such bond shall be subject to forfeiture in the event that there is not compliance with all the Village's ordinances and regulations.
The applicant shall agree to indemnify and save harmless the Village of Woodridge, its Board of Trustees and any and all Village employees or agents, in a form suitable to the Village Attorney, from any claim for damages resulting from the operation of the carnival, circus or other special event for which a permit has been issued.
Any offense committed against this chapter is hereby declared to be a violation, punishable by a maximum fine of $250 or by imprisonment for not more than 15 days, or both.
