Modifications to this chapter shall be granted by the Supervisors under the modification provisions of the subdivision and land development regulations [Chapter 22] of the Township of Richmond, Pennsylvania.

1. 
It shall be the duty of the Richmond Township Supervisors to enforce the provisions of this chapter.
A. 
It shall be the responsibility of the Richmond Township Supervisors to make, or cause to be made, annual inspections of all parks in the Township.
B. 
If the Richmond Township Supervisors shall find that any park has been established or is being maintained in violation of the provisions of this chapter, it shall promptly notify the owner thereof in writing. If the owner fails to abate the said violation(s) and comply with the provisions of this chapter within 30 days, the Supervisors may either cause such violation to be removed or remedied (the cost of such removal or remedy shall be borne by the owner or lessor and shall be a lien upon the premises), or suspend the permit of the park, giving the person to whom the permit is issued notice in writing of such suspension.
C. 
The Richmond Township Supervisors shall cause any violation of the provisions of this chapter, which is an immediate peril to persons or property, to be removed immediately. The cost shall be borne by the park owner and may result in a lien upon the premises.

The Codes Enforcement Officer or such other individual as may be designated by the Board of Supervisors shall perform the following, at a minimum:
A. 
Shall inspect the park as required in § 14-402, Subsection 1A.
B. 
Shall inspect the park during its construction to assure compliance with applicable ordinances and shall issue a certificate to the Board of Supervisors accordingly.

1. 
Any person affected by any notice or decision which has been issued in connection with the enforcement of any provision of this chapter may request and shall be granted a hearing on the matter before the Richmond Township Board of Supervisors.
2. 
Such person shall file with the Secretary of the Board of Supervisors, a written petition requesting a hearing and setting forth a brief statement of the grounds for appeal or waiver. In the case of an appeal from a decision, said appeal shall be filed within 10 days of the date of service.
3. 
The filing of a request for a hearing shall operate as a stay of the notice and suspension of further action, except in a case where immediate action is necessary to protect the public health.
4. 
Upon receipt of a petition, the Board of Supervisors shall set a time and place for a hearing and shall give the petitioner written notice thereof.
5. 
After such hearing the Board of Supervisors shall make findings as to compliance with the provisions of this chapter and shall issue an order in writing.

1. 
It shall be unlawful for any person to construct, alter or extend any park within the limits of Richmond Township, unless he holds a valid permit issued by the Township Board of Supervisors in the name of such person for the specific construction, alteration or extension proposed and also has plans approved by the Richmond Township Supervisors.
2. 
Upon receipt of an application, the Richmond Township Supervisors shall forthwith inspect the applicant's plans and proposed park to determine compliance with the provisions of this chapter. After favorable determination with the same, the Supervisors shall issue a park permit to the applicant which shall be valid for a period of one year thereafter.
3. 
Renewal permits for a one-year period may be issued by the Board of Supervisors providing the annual inspection shows the park continues to conform to the standards prescribed by this chapter.
4. 
All homes shall be required to obtain a mobile home placement permit.
5. 
No permit shall be issued until the Board of Supervisors shall have received all necessary inspection certificates.

1. 
Plan Fee. At the time of filing for approval of the plan for a park, the application shall be accompanied by the appropriate fee for review of said plans. This fee shall be determined and established from time to time by resolution of the Board of Supervisors. In the event the Board is required to perform additional or unusual services in determining if said application conforms to the provisions of this chapter, the cost of such additional service shall be borne by the applicant. Such charges shall be levied whether or not the application is approved.
2. 
Other Fees. An applicant for a mobile home park or mobile home placement permit, or any holder of such a permit, shall pay such other fees as shall be established from time to time by the Board of Supervisors.

Permits are not transferable. Every person holding a permit shall file notice in writing to the Board of Supervisors of Richmond Township at least 30 days before having sold, transferred, given away or otherwise disposed of interest in, or control of, any park or mobile home. The prospective new owner must make application for a permit during this period.

Any person who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine not exceeding $600 and costs and, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.

An approval issued in violation of the provisions of the chapter is void without the necessity of any proceedings for revocation, suspension or termination. Any work undertaken pursuant to such approval is unlawful. No action may be taken by a board, agency or employee of the Township purporting to validate such a violation.

Where any provision of this chapter imposes restrictions different from those imposed by any other provision of this chapter or any other ordinance, rule or regulation or other provision of law, whichever provisions are more restrictive or impose higher standards shall control.
