A. 
General: conducting the business of a peddler, solicitor or transient merchant in an unlawful manner or in such a manner as to constitute a menace to health, safety or general welfare of the public.
B. 
Frequency. A peddler, solicitor or transient merchant shall not frequent any private property or road in an exclusive manner so as to cause a private or public nuisance.
C. 
Hours of operation. The allowable hours of operation shall be one hour after sunrise until one hour before sunset.
D. 
Measuring devices. A peddler, solicitor or transient merchant shall not use any weighing or measuring device unless the same shall have been examined and sealed by the County Sealer of Weights and Measures.
E. 
Noises. A peddler, solicitor or transient merchant shall not cause attention to his or her goods, wares, merchandise or services by blowing a horn, by ringing a bell, by shouting or crying by any loud or unusual noise, except that peddlers of ice cream and ice cream products for immediate consumption are exempt from the foregoing prohibition of the use of a bell.
F. 
Obstructions. A peddler, solicitor or transient merchant shall not create or maintain any booth or stand or place any barrels, boxes, crates or other obstructions upon any road, sidewalk, right-of-way, or other type of public place for the purpose of selling or exposing for sale any goods, wares or merchandise.
G. 
Orders. All orders taken by a peddler, solicitor or transient merchant that demand, accept or receive payment or deposit of money in advance of final delivery shall be in writing in duplicate, stating the terms of such payment or deposit and the amount paid in advance, and one copy shall be given to the purchaser at the time the deposit is paid to such peddler, solicitor or transient merchant.
H. 
Safety of vehicular or pedestrian traffic. A peddler, solicitor or transient merchant shall not stand or permit the vehicle used by herself/himself, his/her agent or employee or his/her cart or other appliance for the display of his/her goods, wares or merchandise to stand in any public place, road or right-of-way in such a manner as to obstruct vehicular or pedestrian traffic or to obstruct the line of vision of such traffic so as to create a substantial risk of harm or risk to the safety of others.
I. 
Sanitary conditions.
(1) 
A peddler, solicitor or transient merchant shall keep the vehicles, property and/or receptacles used by him or her in a clean and sanitary condition.
(2) 
A peddler, solicitor or transient merchant who also classifies as a mobile food service establishment or pushcart shall conform to the applicable regulations prescribed within Part 14, Subpart 14-4, of the Sanitary Code of NYS.
J. 
Town endorsement. No peddler, solicitor or transient merchant shall represent in any manner that the Town or its agents or officers have endorsed such person or the goods, wares, merchandise or services.
K. 
Unlawful sales. A peddler, solicitor or transient merchant shall not falsely or fraudulently misrepresent the quantity, character or quality of any article offered for sale or offer for sale any unwholesome, tainted or diseased provisions or merchandise.
