As used in this Part, the following terms shall have the following
meanings:
ASHES
The residue from fires used for cooking or for heating buildings.
BULK REFUSE
Any item of refuse which is larger than the size that can
be placed in an authorized container including furniture, bedding,
appliances, and Christmas trees.
GARBAGE
All wastes from the preparation, cooking and serving of food.
RECYCLABLES
Glass bottles and jars, newspapers, aluminum and steel cans,
and plastic containers.
REFUSE
Includes garbage, rubbish and ashes, as hereinabove defined,
but shall not include street sweepings, catch basin dirt, dead animals,
furniture, bedding, building materials, abandoned vehicles, or industrial
waste of any kind.
RUBBISH
Waste paper, (not including newspaper), cartons, boxes, wood,
tree branches, yard trimmings, metals, dirt, crockery and similar
waste materials.

All refuse as hereinabove defined shall be gathered, collected
and hauled away by a collector authorized by the Borough as hereinafter
provided.

The Borough Council shall award a contract for the collection
and disposal of refuse, after competitive bidding, for such term of
time not exceeding five years as the Borough Council may from time
to time determine.

1. No such contract shall be awarded or become binding upon the Borough
unless and until the contractor shall have furnished to the Borough
the following:
A. Proof of insurance coverage, vehicular liability insurance, in amounts
of $1,000,000 per person and $2,000,000 per accident; public liability
insurance; and workmen's compensation insurance. All such insurance
coverages shall be maintained by the contractor, as a continuing condition
of the contract.
B. Performance bond, with corporate surety, in such amount as the Borough
may determine and announce in advance to all prospective bidders,
conditioned for the proper performance of the contract, indemnification
of the Borough from all claims arising therefrom.

The Borough Council may from time to time adopt regulations
for carrying out, administering and effectuating the matters provided
herein.

The residents, householders, proprietors of business establishments,
or other persons to whom refuse collection service is afforded hereunder,
shall place all refuse from their respective premises in one or more
watertight vessels or receptacles, and place the same in the location
designated for pick-up (curb in front or alley at rear, as may be
specified in regulations on the subject) on the day specified for
pick-up (or night before). All such receptacles shall be promptly
removed from the sidewalk, curb or alley immediately after collection
is completed.

Refuse pick-up shall occur twice each week. Collections shall
be made between the hours of 6:00 a.m. and 5:00 p.m. Recycling materials
shall be picked up once a week from 6:00 a.m. to 5:00 p.m.

Garbage may be placed in the same container with other refuse,
but all garbage shall be drained of liquid content and wrapped in
newspaper or other suitable material. Leaves shall be placed in biodegradable
bags for separate collection on designated days.

Containers shall be of standard refuse-type, and shall not exceed
20 gallons in size or 65 pounds in weight (including contents). Each
household and each business establishment shall be entitled to have
up to but not more than three such containers of refuse collected
per pick-up.

Wherever practicable, pick-ups shall be made from alleys at
the rear or alongside of premises served, but where such pick-up is
not practicable, pick-ups shall be made from the curb in front of
premises served, but such receptacles shall not be placed at the curb
until after 6:00 p.m. the evening before the day of collection, and
shall be removed from the curb by 7:00 p.m. the day of collection.
Provided, until further notice, the following alleys are to be regarded
as not suitable for alley pick-up of refuse:
Alley behind 400 and 500 blocks of Jefferson Avenue.
Alley behind 1000 block of Pond Street.

No pick-ups will be made on any of the following legal holidays;
viz, New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving
Day, Christmas and Martin Luther King's Birthday.

Bulk refuse pick-up shall occur once each week. Collection shall
be made between the hours of 6:00 a.m. and 5:00 p.m. No more than
three items of bulk refuse shall be placed for collection on any one
day.

In the event of any departure from the normal collection schedule,
contractor shall first obtain the permission of the Borough Council
to make such change, and shall give due notice thereof to the public.

Except for the special collection referred to for recyclables
above, the contractor shall use only fully enclosed, packer-type vehicles
of sufficiently tight construction to prevent liquids, refuse or ashes
from spilling, leaking or blowing therefrom and to hold at least six
inches of water. Each such vehicle shall be of at least 17 cubic yard
capacity.

Contractor shall be liable to a penalty of $1,500 for each day
when scheduled pickup is not carried out (unless permission has been
given by the Borough Council for deviation from schedule, as above
set forth). In the event collection is made as to substantially all
premises scheduled to be covered on a given day, but through inadvertence
or oversight a give street or alley is missed, contractor shall promptly
rectify the omission by special collection; otherwise, a penalty of
$7,500 shall be imposed. All penalties imposed hereunder may be deducted
by the Borough from the amount due the contractor. In addition, if
the Borough is required to take action to clean trash or debris left
by contractor during collection, the Borough shall have the right
to impose a penalty in the amount of the Borough's cost to accomplish
the required cleanup.

No person or persons, firm or corporation shall keep or suffer
to remain upon his or its premises, or on any private property, any
garbage, offal, carcass, putrid matter or other refuse or trash, or
cast the same upon the shore or margin of any body or stream of water,
or upon any dock or wharf or into any sewer inlet, or upon any sidewalk.
Provided, nothing herein shall apply to the storage of building material
pending usage upon the property, or to garbage, ashes and rubbish
stored as required while awaiting collection, provided that all applicable
provisions of all other ordinances of the Borough are adhered to in
the storage and placement thereof.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each section of this Part which shall be found to have been violated
shall constitute a separate offense.

1. An owner of a multi-family structure containing seven or more dwelling
units on a single tax parcel shall be exempt from more than one assessment
charge from the Borough refuse assessment if the following conditions
are met:
A. Refuse is collected in an adequate dumpster on the same property
as the dwelling unit.
B. Refuse is collected on a comparable schedule to the Borough refuse
collection in reference to frequency of service and bulk pickup capacity.
C. A copy of the refuse collection contract with a licensed hauler is
filed with the Borough on an annual basis. Any changes in the contract
shall be filed with the Borough within 30 days of the effective date
of the change.
