The Board of Supervisors of New Hanover Township, Montgomery
County, Pennsylvania, find it to be in the best interest of Township
residents that all building contractors who engage in building trades
within the Township shall be required to register with the Township,
obtain a license and pay a license fee prior to engaging in such building
trade activities.

As used in this part, the following terms shall have the meanings
as indicated:
BUILDING CONTRACTOR
Includes any person engaged as a building contractor or in
the following trades: carpenter, plumber, electrician, excavator,
mason, building siding installer, roofer, paver, or concrete contractor,
general building contractor or any person engaged in construction,
alteration or repair of buildings or other structures, road construction
or building development for which a permit is required under the applicable
zoning, subdivision or building ordinances of the Township.
LICENSE
Contractor's registration license issued by New Hanover Township.

No person, partnership, association, corporation or like entity,
applying for a permit or named on the permit application as the contractor
performing the work, shall engage in business within the Township
without first registering with the Township as herein provided. Exempt
from registration are the following: public utilities, telecommunications
providers, homeowners performing work on their own property, and appliance
installation and repair.

1. The annual fee for the license shall be as set forth from time to
time by resolution of the Board of Supervisors in the Township fee
schedule. All contractors licenses shall expire at midnight on December
31 of each year unless the license is revoked or suspended prior thereto
under the terms of this part.
2. There shall not be a pro-rated reduction in the registration fee,
and no fee or portion thereof shall be returned in the event that
the license is revoked or suspended or if the building contractor
ceases to do business in the Township.

Any person or entity doing business as a subcontractor will
be construed as engaged in the business of a building contractor for
which registration and a license are required by this part when applying
for a permit or named on the application as the contractor performing
the work.

Applications for registration hereunder shall provide all requested
information and shall be accompanied by a certificate evidencing coverage
under a current public liability insurance policy, with the limits
of not less than $100,000 per person, $300,000 per occurrence for
bodily injury liability, and $100,000 on property damage liability.
In addition, proof of adequate insurance coverage for builders' risk
and workers' compensation satisfactory to Township must be provided.

Application for registration shall be filed with the Building
Code Official of the Township, who shall issue the license or deny
registration within five working days of the date of the receipt of
the completed application.

This part shall not be deemed to create any rights or claims
against the Township, its agents, servants or employees by any person
or entity who shall claim damage from any contractor who has performed
work in the Township without complying with the provisions of this
part.

The Building Official may suspend or revoke any registration
and license issued under the provisions of this part where it is found
that the contractor has violated any provisions of this part, or is
performing or attempting to perform any act prohibited by this part
or any other Township ordinance.

1. Any person who shall violate any provision of this part or who permits
the violation of any provisions of this part, upon conviction thereof
in an action brought before a magisterial district judge in the manner
provided for the enforcement of summary offenses under the Pennsylvania
Rules of Criminal Procedure, shall be sentenced to pay a fine of not
less than $100 nor more than $1,000 plus costs and, in default of
payment of said fine and costs, to a term of imprisonment not to exceed
90 days. Each violation for each separate day and each violation of
any provision of this part shall constitute a separate and distinct
violation.
2. Any person who violates or permits the violation of any provision
of this part shall, upon being found liable therefore in a civil enforcement
proceeding commenced by New Hanover Township, pay the fine prescribed
by this part, plus all court costs and fees and expenses of New Hanover
Township, including reasonable attorney and other professional fees.
