New Hanover Township is authorized to enter into an Intergovernmental
Cooperation Agreement in accordance with and pursuant to the terms
of the Intergovernmental Cooperation Act, 53 Pa.C.S.A. § 2301,
to create a Board of Appeals under the Uniform Construction Code.

The intergovernmental agreement shall have an initial term of
one year and shall automatically renew for successive five year terms.

The purpose and objectives of the intergovernmental cooperation
agreement is to establish a Board of Appeals to hear appeals pursuant
to the Pennsylvania Construction Code, Act of November 10, 1999, 35
P.S. § 7210.101 et seq. The agreement intends to delegate
the jurisdiction and powers of the Board of Appeals to the Board of
Appeals to be created under the terms of the intergovernmental cooperation
agreement.

The agreement will be financed by filing fees imposed on appellants
filing appeals with the Board of Appeals.

The organization structure necessary to implement the agreement
will be the creation of a five-person Board of Appeals in accordance
with the provisions of the Pennsylvania Construction Code and related
codes.

There will be no real or personal property to be acquired, managed,
licensed or disposed of. The Board of Appeals will not have any employees
and there is no need for any contracts for policies of group life
insurance and employee benefits.
This part authorizes New Hanover Township to enter into the
Intergovernmental Cooperation Agreement to create a Board of Appeals
in accordance with said Agreement to create a Board of Appeals in
accordance with said agreement, which is incorporated herein by reference.
