It shall be unlawful for any person, firm or corporation or any agent thereof to place, throw, store, dispose of, accumulate or maintain, or cause to be placed, thrown, stored, disposed of, accumulated or maintained any used cans, papers, paper boxes, used lumber, rubbish, debris, animal matter, garbage, empty bottles or other containers upon any property within New Hanover Township or on or near any highway, alley, public lands or stream located in said New Hanover Township, except in accordance with any New Hanover Township ordinance dealing with the collection of garbage, refuse, trash or solid waste [Chapter 20].

It shall be the duty of every person occupying, in possession, charge or in control of any dwelling, apartment, rooming house, apartment house, hospital, school, hotel, club, restaurant or eating place or occupying, in possession, charge or control of any shop, place of business, or manufacturing establishment where garbage, refuse, debris or swill is created or accumulated, at all times to keep or cause to be kept a secure, strong, watertight, rodent-proof and insect-proof container or containers, of sufficient capacity, for the deposit therein of garbage and refuse, and to deposit or cause to be deposited the same therein.

Any person, firm or corporation who shall violate any provision of this part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $25 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this part continues or each section of this part which shall be found to have been violated shall constitute a separate offense.
