In accordance with the vote of the 1994 Annual Town Meeting and the provisions of Section 13 of M.G.L. Chapter 40A, the Zoning Act, the ZBA hereby establishes the position of Zoning Administrator and delegates to him the limited authority set forth in Article
V, §
135-30 and its subsections above.
The Zoning Administrator is the Building Commissioner, but the
ZBA may choose by majority vote to appoint someone else. The appointment
is subject to confirmation by the Selectmen.
The ZBA may, by vote of its regular members, terminate the services
of a particular appointee at any time and may change the scope of
his authority from time to time. However, the scope of his authority
shall not exceed that explicitly authorized by vote of Town Meeting.
Appeals from the decisions of the Zoning Administrator, or from
the refusal of the Zoning Administrator to act on an application,
shall be filed with the Town Clerk within 30 days of said decision
or refusal. However, because of the limited nature of the Administrator's
authority under these rules, the appellant is urged also to apply
in the alternative for appropriate zoning relief. To avoid repeated
hearings on the same substance, the ZBA may on its own motion consolidate
consideration of the special permit with the application for an appeal.
The fee for an appeal from a decision or refusal to act by the
Zoning Administrator shall be the same as for a special permit. There
will be no additional fee assessed for converting the appeal into
an application directly to the ZBA for a special permit for a Section
6 of M.G.L. Chapter 40A finding or special permit.
