1. The Council finds that:
A. Certain streets in residential areas of the Borough of Beaver are
unduly congested by the movement and parking of commuter vehicles
(as identified below).
B. Such congestion is due to the proximity of governmental facilities
and commercial establishments which attract a considerable number
of commuter vehicles.
C. Such congestion has had an adverse impact upon the residential character
of the affected areas and poses a threat to the health, safety and
welfare of residents of those areas.
D. Such congestion by commuter vehicles substantially inconveniences
the local residents, by depriving them of the opportunity to park
their own vehicles near their homes.

1. The purposes of this Part are to:
A. Preserve the character of residential districts of this Borough.
B. Protect the health and safety of local residents by minimizing vehicular
traffic in neighborhoods and thereby reducing danger to children and
other pedestrians and preventing air pollution from automotive emissions.
C. Conserve the value of property in residential districts of this Borough.
D. Promote the convenience, comfort and general welfare of residents
of this Borough.

As used in this Part, the following words and phrases shall
have the meanings specified:
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person
who is not a resident of the Borough of Beaver.
MOTOR VEHICLE
An automobile, van, truck, jeep, utility vehicle or motorcycle.
RESIDENT
An individual who owns or leases real property in a residential
area, or who is a bona fide resident of such area as either a member
of a resident's household, or otherwise.
RESIDENTIAL AREA
Any area classified as an R-1 (low density residential) District under the Zoning Ordinance [Chapter
27] and official Zoning Map of the Borough of Beaver, or any part thereof designated by the Council.

1. The following residential area streets are designated for parking
by valid permit only:

2. Signs shall be erected and maintained along the designated streets
to indicate the days and hours when a residential parking permit is
required.

The parking of motor vehicles on the streets designated above,
between 8:00 a.m. and 4:00 p.m. on Monday through Friday, is limited
and restricted to only those vehicles which display a valid residential
parking permit.

1. Any person desiring to obtain a residential parking permit shall
submit a written application to the Chief of Police on a form prescribed
for that purpose. Such application shall set forth the applicant's
name, residence address and driver's license number and the make,
model and registration plate number of the subject vehicle. Upon request,
the applicant shall present for inspection his or her driver's license
and the vehicle's registration card.
2. The application shall be accompanied by payment of the fee prescribed
by the Council to defray the costs to the Borough for administering
the permit program.
3. A separate application and fee shall be required for each vehicle.
4. A local resident may apply for a permit to authorize parking by visitors
of such resident. No more than one visitor permit may be issued to
any one dwelling unit within the residential area. The application
for a visitor permit shall state the reason(s) why the permit is being
requested.

1. Upon finding that the applicant is entitled to a residential parking
permit, the Chief of Police shall issue it. The permit shall show
the registration number of the motor vehicle, the name and address
of the holder, and the expiration date. All permits shall automatically
expire on December 31. Permits shall be renewable annually before
the expiration date, upon making the application for renewal and payment
of the permit fee.
2. Upon finding that the reason(s) presented for a visitor permit establish
good cause, the Chief of Police shall issue it. Such a permit may
be limited in its duration, according to the circumstances shown.

1. The holder of a residential parking permit shall be permitted to
park a motor vehicle in any designated residential parking area during
those times when a parking of motor vehicles is permitted in that
area. While a vehicle for which a residential parking permit has been
issued is so parked, that permit shall be displayed so as to be clearly
visible through the windshield of the vehicle.
2. A residential parking permit shall not guarantee or reserve to the
holder a parking space within a designated residential permit parking
area.
3. A residential parking permit shall not authorize its holder to park
a motor vehicle in any place where or at any time when stopping, standing
or parking of motor vehicles is prohibited or set aside for other
specified types of vehicles, nor shall the permit exempt its holder
from the observances of any traffic or parking regulation other than
those specified in the Part.
4. The holder of a permit who ceases to be a resident in a designated
parking area shall so notify the Chief of Police and shall surrender
his or her parking permit.

The Chief of Police shall have authority to revoke the parking
permit of any permit holder found to be in violation of any provision
of this Part. Upon written notification to him or her of the revocation,
the permit holder shall surrender the permit to the Chief of Police.

1. It is unlawful to park a motor vehicle on a street designated in §
15-604 of this Part between the hours of 8:00 a.m. and 4:00 p.m. on Monday through Friday unless a valid residential parking permit is displayed in such vehicle.
2. It is unlawful for the holder to transfer a residential parking permit
to any other person.
3. It is unlawful to display a residential parking permit in a vehicle
other than that for which such permit was issued.
4. It is unlawful to furnish false information in connection with an
application for a residential parking permit.
5. It is unlawful to make or to display a counterfeit residential parking
permit.

Any person who violates any provision of this Part shall, upon
conviction, be sentenced to pay a fine of $35, together with any costs
of prosecution.

This Part may be enforced by officers of the Beaver Police Department
and by the Borough's Parking Enforcement Officer.
