No person, association, firm or corporation shall operate, or cause to be operated, any vehicle on the highway anywhere in the Township with traction or road contact surfaces other than pneumatic tires unless of a type, size, and construction permitted by regulations of the Pennsylvania Department of Transportation and unless the operation and movement on the highway is made under specific conditions allowed by regulations and resolutions of the Township and Pennsylvania Department of Transportation.
The Board of Supervisors may provide permits for the crossing of highways or roads in the Township with vehicles having nonpneumatic tires in conflict with the provisions of the article, provided that the permittee place appropriate material approved by the Board of Supervisors, such as rubber matting or similar cushion material, at the crossing site between the road surface and the traction surface of the vehicle, and that the permittee agree to accept financial responsibility for excess maintenance on the portion of the highway to be used by the permittee. The permittee must also enter into an excess maintenance agreement with the Township. The agreement will provide that the portion of the highway to be used by the permittee will be inspected prior to and subsequent to its use and that the Board of Supervisors shall have authority to repair or replace the damaged or destroyed portion of road or highway and seek reimbursement for such repair from the permittee. The Board of Supervisors is authorized to charge an issuance fee for each permit, in such amount as shall be set by resolution of the Board of Supervisors. Each permit shall remain in effect for one year from the date of issuance.

Any person, association, firm or corporation which causes or allows a vehicle to operate on the roads or highways within the Township in violation of the terms of this article shall be responsible for all damage or destruction to said roads or highways. The Board of Supervisors shall have authority to repair or replace the damaged or destroyed portion of the road after written notice to such person, association, firm or corporation and to then collect the cost of the repair from said person, association, firm or corporation.

Any person who violates any provision of this article shall, upon conviction thereof before any Magisterial District Judge, be guilty of a summary offense and shall pay the applicable fine as set forth in Chapter 65 of the Pennsylvania Vehicle Code 75 Pa.C.S.A § 6501 et seq.
