[Ord. 1995-1, 2/13/1995; as amended by Ord. 2001-2, 2/12/2001]
1. The Board of Supervisors of East Nottingham Township hereby ratifies
the existence of a Planning Commission in the Township for more than
30 years and additionally establishes the organization of a Planning
Commission under the provisions of the Pennsylvania Municipalities
Planning Code, Act 247 on July 31, 1968, re-enacted and amended by
Act 170 of December 21, 1988, P.L. 1329, 53 P.S. § 10101
et seq.
2. The Planning Commission shall consist of seven members, all of whom
shall be citizens of the Township of East Nottingham, Chester County,
Pennsylvania.
3. The term of office of each of the members shall be four years and
shall expire on December 31 at the conclusion of the four-year term
or until a successor is appointed. Terms of the members of the existing
Planning Commission have been fixed so that only one member's
term concludes in any calendar year. This Part confirms and ratifies
that stagger procedure. In the event of a vacancy other than by a
conclusion of term, the governing body shall appoint a member to fill
the unexpired term of any vacancy.
4. The Planning Commission shall at the request of the governing body have the powers and duties as established by the Pennsylvania Municipalities Planning Code as cited above and the East Nottingham Township Zoning Ordinance [Chapter
27] and the East Nottingham Township Subdivision and Land Development Ordinance [Chapter
22].
