1. The Borough Council may grant a modification of the requirements
of one or more provisions of this chapter if the literal enforcement
will exact undue hardship because of peculiar conditions pertaining
to the land in question; provided, that such modification will not
be contrary to the public interest and that the purpose and intent
of this chapter is observed.
A. All requests for a modification shall be in writing and shall accompany
and be a part of the application for development. The request shall
state in full the grounds and facts of unreasonableness or hardship
on which the request is based, the provision or provisions of the
ordinance involved and the minimum modification necessary.
B. All requests shall be referred to the Planning Commission for review
and recommendations.
C. The Borough shall maintain a written record of all action on all
requests for modifications.

1. The Borough Council may grant a developer permission to use or apply
an alternate standard or method of development when the developer
demonstrates to the satisfaction of the Borough Council that such
alternate standard or method provides equal or better results than
the standards or methods provided in this chapter.

All requests for the application of alternate standards or methods shall proceed and be governed by the provisions of §
22-701, Subsection
1A, above. In addition, any developer requesting the application of alternate standards or methods shall pay as review fees, all reasonable and necessary costs incurred by the Borough, for the review of such alternatives, by the Borough Engineer and professional consultants.
