It shall be unlawful for any person who owns, harbors, keeps or is in charge of any dog to cause, suffer or allow that dog to soil, defile, defecate on or commit any nuisance on any street, alley, sidewalk, passageway, public path, play area, park or any place in Vandergrift Borough where people congregate or walk, or upon any public property whatsoever, or upon any private property without permission of the owner of that property. The restriction in this section shall not apply to that portion of any street lying between the street side of the two sidewalks, which area may be used to curb a dog under the following circumstances:
A. 
The person who curbs the dog shall immediately remove all feces deposited by that dog by any sanitary method approved by the Board of Health.
B. 
The feces removed from the designated area shall be disposed of by the person owning, harboring, keeping or in charge of the dog curbed in accordance with the provisions of this article in a sanitary manner approved by the Board of Health.

Any person who violates any provision of this article shall, upon conviction, be sentenced to pay a fine of not less than $50 or more than $600 and costs of prosecution and, in default of payment of fine and costs, to undergo imprisonment for not more than 30 days.
