No person shall install, construct or request bid proposals
for construction, or alter an individual sewage system or community
system or construct or request bid proposals for construction or install
or occupy any building or structure for which an individual sewage
system or community sewage system is to be installed without first
obtaining a permit indicating that the site and the plans and specifications
of such system are in compliance with the provisions of the Pennsylvania
Sewage Facilities Act, as amended, and the standards adopted pursuant
to said Act.
Application for a permit shall be in writing to the Borough
of Adamstown in accordance with the provisions of the Pennsylvania
Sewage Facilities Act, as amended, and shall be made in such form
and shall include such data as the Department of Environmental Protection
may prescribe.
The Borough of Adamstown shall employ qualified Sewage Enforcement
Officers to administer the provisions of this article and the Pennsylvania
Sewage Facilities Act, as amended.

A. The fees, as established from time to time by resolution, for the
basic permit, alternate system, call-back inspection, and malfunctioning
system investigation shall apply where the Borough Sewage Enforcement
Officer serves as an inspector of the percolation and soil tests as
well as the sewage system under construction, but any other services
relating to the sewage system are performed by the applicant.
B. The fees, as established from time to time by resolution, for the basic permit, alternate system, and call-back inspection shall apply where the Borough Sewage Enforcement Officer performs the services described in Subsection
A of this section and, in addition, conducts the necessary tests and designs the system.
When the Sewage Enforcement Officer is required to inspect deep
probe and percolation holes as a condition precedent to obtaining
approval for proposed subdivisions, the developer shall pay to the
Borough a fee consistent with the costs of performing these inspections
and any related services.
All fees and charges required by §§
237-18 and
237-19 of this Article
III shall be paid prior to the performance of the designated services by the Sewage Enforcement Officer.
The Adamstown Borough Council shall have the power from time
to time to change the fees set forth in the foregoing sections of
this article by a resolution duly adopted by a majority of said Council
at any regular or special meeting thereof.

The violation of this article shall be deemed to be an offense, and any person convicted of the violation of any of the provisions of this Article
III shall be sentenced to pay a fine of not less than $200 and costs and not more than $1,000 and costs and, in default of payment thereof, shall be sentenced to imprisonment in the Lancaster County Prison for a period of time not exceeding 30 days.
