[Adopted 3-19-1923, effective 4-16-1923; amended in its entirety 3-13-1990 by L.L. No. 2-1990]
Any tree or trees shall be kept trimmed by the owner of the property upon which it stands in such a manner as to prevent the limbs, branches or any part thereof from obstructing the sidewalk or street for public use or travel or from overhanging or encroaching upon private property owned by another. All trees and branches overhanging the streets or sidewalks of the Village or overhanging or encroaching upon private property that are dead or decayed or in danger of falling on any street or sidewalk or private property shall be removed by the owner of the property upon which it stands.
A. 
If any such person shall refuse or neglect to trim any tree or trees so situated for a period of three days after receiving written notice by the Superintendent of Public Works requiring the same to be done, the Board of Trustees of the Village may cause said trees to be trimmed and the cost thereof shall be a charge upon and against said premises, to be assessed against same as a tax lien.
B. 
Notwithstanding the provisions of Subsection A hereinabove, and in addition to said subsection, any person, firm, corporation or other entity who or which violates the provisions of § 302-9 hereinabove shall be subject to a Type A penalty as set forth in § 1-15 of the Village Code.
