This Part shall be known as the "Borough of Hatboro Rules and Regulations for the Use of Borough Parks, Open Spaces, and Public Recreation Areas."

1. 
In interpreting this Part, the present tense includes the future, the singular number includes the plural and the plural the singular, and the word person includes natural person, partnership, firm, association, and corporation.
2. 
Unless otherwise expressly stated, the following words shall for the purpose of this Part have the meaning herein indicated:
BOROUGH
The duly incorporated Borough of Hatboro, County of Montgomery, Commonwealth of Pennsylvania, United States of America.
BOROUGH COUNCIL
The duly elected members of the Borough Council of the Borough of Hatboro.
BOROUGH ZONING ORDINANCE
The duly enacted Zoning Ordinance of the Borough of Hatboro.
PARK, OPEN SPACE, RECREATION AREA
All property, real estate, buildings, or other structures owned by the Borough of Hatboro and designated by Borough Council as property, real estate, building, or other structure held for the use of the public for purposes permitted within this Part.
RECREATIONAL VEHICLE
Includes, but not limited to, motorcycle, mini-bike, dirt-bike, snowmobile, all-terrain vehicle (ATV), off-road vehicle (ORV), or other form of motorized conveyance.
VEHICLES
Any motorized device for carrying passengers or goods.

It shall be the intent of this Part to establish standards to protect public property owned by the Borough of Hatboro and the health, safety, and welfare of the public and to set a uniform set of rules for all users to abide by to insure access and availability to the Borough public parks, open space, and recreation areas by all authorized users.

1. 
All public parks and recreational areas including, but not limited to, fields, tennis courts, basketball courts, trails, and the pavilion shall be used only for their intended purpose and no other unless authorized by Borough Council.
2. 
The Borough shall erect and maintain a sign at the entrance or entrances of each park, open space, or public facility that shall contain the following information:
A. 
Name of facility.
B. 
Hours of operation.
C. 
Summary of the rules and regulations for use.
D. 
Other information necessary to inform user of conditions of use and telephone number and hours of operation of the Borough office for further information.
3. 
All parks shall be open from dawn to dusk, except those lighted for evening events or programs.
4. 
It shall be a violation of this Part for any person to remain in any park, open space or recreational facility subject to these regulations after posted hours of operation, unless they have first obtained a special permit from the Borough Manager.
5. 
It shall be a violation of this Part for any person to operate a vehicle or recreational vehicle in any park, open space, or recreational area except on road and parking lots provided for such vehicle operation. This shall not prohibit the use of vehicles by Borough employees for the purpose of park maintenance or service, or the use of vehicles by contractors with prior permission by the Borough Manager for construction, maintenance, or service.
6. 
It shall be a violation of this Part for any person to wash, perform maintenance or exhibit for sale a vehicle or recreational vehicle in any park, open space, or recreational area including roads and parking lots.
7. 
It shall be a violation of this Part for any person to use, sell, or distribute to others or possess any alcoholic beverage(s) in any park, open space, or recreational area except by special exception by Borough Council.
8. 
It shall be a violation of this Part for any intoxicated person to be in any park, open space or recreational area at any time.
9. 
It shall be a violation of this Part for any person to conduct or be involved in the conduct of any illegal activity in any park, open space, or recreational area. Such activity shall include, but not be limited to: gambling, obscene or indecent acts, obscene or indecent language, threatening language, or any conduct that infringes upon the peace and tranquility of the facility or infringes upon the rights of other users.
10. 
It shall be a violation of this Part for any person to possess, discharge, or display any bow and arrows, crossbows, firecrackers or fireworks, or rockets. Professional fireworks displays shall be permitted by prior permit at the discretion of the Borough Council.

11. 
It shall be a violation of this Part for any person to injure, foul, pollute, or deface any building, structure, equipment, sign or water course, dam or stream stabilization facility.
12. 
It shall be a violation of this Part for any person other than Borough employees engaged in park maintenance or authorized contractors to cut, remove, injure, or destroy plants, wildflowers, shrubbery, or trees. This includes removal of downed trees or trees cut up for firewood unless prior permission to do so has been granted by the Borough Manager.
13. 
It shall be a violation of this Part for any person to erect any structure or install plant material on parkland or open space or to assume parkland or open space for personal use.
14. 
It shall be a violation of this Part for any person to permit pet animals including, but not limited to, dogs, cats, and horses, to be in any park or open space, except in designated areas.
15. 
It shall be a violation of this Part for any person to scatter, drop, or leave litter except in receptacles provided for that purpose. It is a further violation for any person to dump household waste or construction, commercial, or landscape debris in receptacles or on parkland or open space areas for removal by the Borough.
16. 
It shall be a violation of this Part for any person to deface or destroy any notices, rules or regulations for the regulation of the park and open space posted within any park or open space by the Borough.
17. 
It shall be a violation of this Part for any person to start or cause to be started a fire in any park or open space except in designated areas where fireplaces, stoves, or grills are provided by the Borough or when a special permit has been issued prior to an authorized event. All fires must be completely extinguished before the user leaves the site.
18. 
It shall be a violation of this Part for any person to use any park or open space for any activity which will cause permanent or long-term severe damage to any turf area, trees, or streams in any park or open space. Activities and games shall take place in areas designated for such use. Individuals or groups shall be held responsible for any damages.
19. 
It shall be a violation of this Part for overnight parking in Borough parks, open space, or trails except by the approval of the Borough Manager.
20. 
It shall be a violation of this Part to hunt, trap, feed, or harm wildlife and/or waterfowl, or annoy, strike, injure, maim, or kill any animal or bird except by the approval of the Borough Manager.
21. 
It shall be a violation of this Part to abandon a wild and/or domestic animal on Borough park property.
22. 
It shall be a violation of this Part to solicit or sell any goods or food or the conduct of any commercial activity except for concessions authorized by the Borough Manager.
23. 
It shall be a violation of this Part to make unreasonable noise and use sound amplification equipment unless approved by the Borough Manager.
24. 
It shall be a violation of this Part to skateboard, bike or use rollerblades (inline skates) on basketball courts, tennis courts, or other designated areas.
25. 
It shall be a violation of this Part to hit golf balls on athletic fields.
26. 
It shall be a violation of this Part to participate in camping or associated activities unless authorized by the Borough Manager.
27. 
It shall be a violation of this Part to exceed the speed limit of five mph in Borough parking lots.
28. 
Borough Parks. The following parks are established as parks owned, operated, and regulated by the Borough:

A. 
Miller Meadow: (South York Road and Horsham Road).
B. 
Hatboro Little League Field: (2 Blair Mill Road, Hatboro, PA 19040).
C. 
Memorial Park: (330 West Moreland Avenue).
D. 
Eaton Park: (321 West Moreland Avenue).
E. 
Tanner Park: (329 Jefferson Avenue).
F. 
Hatboro Pool: (330 West Moreland Avenue).
G. 
Celano Park: (Drummers Way/Woodwinds).

1. 
In addition to the foregoing general rules and regulations, the Borough or agents/operators of leased Borough facilities may establish additional rules and regulations for the purpose of maintaining the safety, health, and welfare of the users of those facilities.
2. 
Hatboro Little League fields shall be used in accordance with the terms of a lease which shall be negotiated from time to time between the Borough of Hatboro and Hatboro Little League, Inc. Hatboro Little League, Inc., shall provide the Borough of Hatboro with a copy of all rules and regulations on an annual basis established by that organization for the use, maintenance and operations of the facilities. Said copy to be kept on file in the office of the Borough Manager.
3. 
Hatboro Memorial Pool and the Memorial Pool snack bar facilities shall be operated by employees or lessee engaged by the Borough for that purpose. Dates and hours of operation shall be established from time to time by Borough Council. Borough Council shall be responsible for the employment of a pool manager on an annual basis. The Memorial Pool manager shall establish rules and regulations for the use and operation of the pool and shall provide on an annual basis to the Chairman of the Borough Council Parks and Recreation Committee a copy of the rules and regulations and any changes as they occur. All such rules and regulations shall be subject to final approval of Borough Council. Access to the pool shall be by membership or on a daily fee basis. Membership fees and daily fees shall be established from time to time by resolution of Borough Council.
4. 
Miller Meadow Open Space shall be preserved in a natural condition and shall be available for the enjoyment of all persons and also subject to the rules and regulations established by the County of Montgomery. The rules which are established by the County, the participants are to be aware of and are subject to those rules and regulations. The Borough Public Works Department shall conduct minimum maintenance and facility improvements to ensure compliance with all Borough, county, state, and federal regulations. There shall be no permanent structures or facility improvements without prior approval of Borough Council. Use of the open space facilities by groups, organizations, or associations shall only be permitted by prior approval by Borough Council. All groups, organizations, or associations shall present a detailed written plan for the use of the facility to Borough Council at least 45 days prior to the date the use is requested. Use of this facility shall require a prepaid fee to the Borough of Hatboro and may require an additional deposit to ensure restoration of the facility to the condition prior to use. The fee(s) and required deposit shall be established from time to time by resolution of Borough Council.
5. 
Memorial Park and Tanner Park shall generally be open year-round for the use of Borough residents and their guests. All users shall be subject to the provisions of this Part and any ordinances or laws governing conduct and use of public facilities. Picnic facilities shall be available to users on a first-come first-served basis. Families or groups may make reservations through the Borough Manager for use of these facilities for special picnics or outings. Teams or organizations wishing to use the ball field facilities shall be required to reserve the facilities 30 days prior to the use date. Reservations shall be made through the Borough Manager. Reservation fees and user deposits may be required and when required shall be established from time to time by resolution of Borough Council.
6. 
Eaton Park shall generally be open year-round to anyone. Use of tennis court and basketball facilities shall be subject to hours of operation set by the Parks and Recreation Committee of the Borough Council and shall be available on a first-come first-served basis but may be reserved by groups or organizations through the Borough Manager. Reservations shall be made 30 days in advance of the use date. Reservation fees and user deposits may be required and when required shall be established from time to time by resolution of Borough Council.
7. 
Borough Council shall have the right to establish user fees and permit fees in addition to those required by this Part, as deemed necessary for the operation and maintenance of parkland facilities. Fees shall be established from time to time by resolution of Borough Council.
8. 
Celano Park shall be preserved in a natural condition and shall be available for the enjoyment of all persons and also subject to the rules and regulations established by FEMA. The participants are to be aware of and are subject to those rules and regulations. 1. 
It shall be a violation of this Part for any person, group, organization, or association to erect, post, or cause to be erected or posted any sign, banner, poster, or broadside within the boundaries of any park, open space, or recreational facility, with the following exceptions:
A. 
Hatboro Little League Fields. Only signs, banners, posters, and broadsides authorized by Hatboro Little League, Inc., shall be permitted.
B. 
Hatboro Memorial Pool Only signs, banners, posters, and broadsides authorized by the pool manager shall be permitted.
C. 
Hatboro Memorial Pool Snack Bar. Only signs, banners, posters, and broadsides authorized by the snack bar manager shall be permitted.
D. 
None of the above regulations shall prevent the erection of signs by the Borough of Hatboro and any municipal authority or any municipality, county, state, or federal entity for the purpose of public information, safety, health, or welfare.
2. 
All signs, banners, posters, or broadside as noted in paragraphs .A through .D above are subject to review by the Hatboro Borough Council and their approval.

Any person, firm, or corporation who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
