As used in this Part, the words "garbage," "refuse," and "ashes" have the following meaning.
ASHES
Residue from fires used for cooking and for heating buildings.
GARBAGE
Wastes resulting from the handling, preparation, cooking, and consumption of food; wastes from the handling, storage, and sale of produce.
REFUSE
Combustible trash, including paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, leaves, wood furniture, bedding; noncombustible trash, including metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, other mineral waste; street rubbish, including street sweeping; dirt, catch-basin dirt, contents of litter receptacles. Provided, refuse shall not include earth and wastes from building operations, nor shall it include leaves, cornstalks, stubble, or other vegetable material generated in the course of harvesting agricultural crops.

It shall be unlawful to place or permit to remain anywhere in the Township any garbage, or other material subject to decay other than leaves or grass, excepting in a tightly covered container; excepting that a mulch heap is permitted, which is properly maintained for gardening purposes and does not materially disturb or annoy persons of ordinary sensibilities in the neighborhood.

It shall be unlawful to cause or permit to accumulate any dust, ashes, or trash of such a material that it can be blown away by the wind anywhere in the Township excepting in a covered container.

It shall be unlawful to deposit or permit to fall from any vehicle any garbage, refuse, or ashes on any public or private street or alley in the Township or in any ditch or easement area, provided, that this Part shall not be construed to prohibiting placing garbage, refuse, or ashes in a container complying with the provisions of this Part preparatory to having such material collected and disposed of in the manner provided herein.

It shall be unlawful to dump or place any garbage, refuse, or ashes on the premises of another in the Township without first obtaining a permit from the Township Zoning Office authorizing same. It shall also be unlawful to dump or place any garbage, refuse, or ashes into any residential, commercial, or municipal refuse containers in the Township without first obtaining permission of the subscriber.

It shall be unlawful to any individual, firm, or corporation to store more than 14 days of garbage as defined by this Part which may pose a potential health and safety problems to the community.
A. 
Garbage, refuse, or other items to be removed by trash operators with the Township shall not place such items at the edge of any public or private roadway within the Township more than 24 hours prior to pickup.
B. 
All empty garbage containers must be removed from the edge of any public or private roadway within the Township no more than 12 hours after pickup.

Any person, firm, or corporation violating any provision of this Part upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $50 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense. Failure of any occupant of premises within the Township to remove garbage, refuse or ashes from his or her premises within 10 days of notice by the Township to do so shall be prima facie evidence that the occupant of such premises is responsible for a violation of this section.
