The term "fowl," as used in the Part, shall include both domestic and game and shall include chickens, ducks, turkeys, guineas, guineas, pigeons, pheasants or any other feathered birds maintained or kept in captivity.

The term "animal," as used in this Part, shall include both domestic and wild and shall include horses, cows, mules, rabbits, pigs, sheep, goats, raccoon, skunk, fox or any domestic or wild animal kept in captivity.

All persons, firms, corporation or corporations, agent or agents thereof from and after the passage of this Part who shall be engaged in the keeping or rasing of fowl and/or animals, whether wild or domestic, shall at all times keep said fowl and/or animals properly housed, caged or penned in stables, pens or coops provided for them by their owners or keepers.

All stables, pens or coops in which said fowl and/or animals are kept and quartered shall be so maintained and kept clean and sanitary in such a manner as not to become a health menace to the peoples of the community or any section thereof and no fowl or animal shall be permitted to run at large at any time or in any manner.

All enclosures for animals and coops for poultry, other than crates in bona fide poultry stores, must be located at least 50 feet from any inhabited building or street line.

All fowl and/or animals running at large and stables, pens, coops or hutches which are not maintained and kept in a clean and sanitary manner shall be declared to be nuisances and subject to a fine or penalty as hereinafter provided by law.

Any individual, firm, corporation or entity who violates, causes or permits the violation of any provision of this Part, upon conviction thereof in an action brought before a Magisterial District Judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

In addition to any other remedy available under law, the Township may enforce this Part by an action in equity. All fines and penalties collected for violation of this Part shall be paid to the Township Treasurer. The initial determination of violation and the service of notice violation are hereby delegated to the Township Secretary, the Police Chief, the Building Inspector and the designees and to any other officer or agent that the Township Secretary or the Board of Supervisors shall deem appropriate.
