As used in this Article, the following terms mean:
ENTER UNLAWFULLY or REMAIN UNLAWFULLY
A person enters or remains in or upon premises when he or
she is not licensed or privileged to do so. A person who, regardless
of his or her purpose, enters or remains in or upon premises which
are at the time open to the public does so with license and privilege
unless he or she defies a lawful order not to enter or remain, personally
communicated to him or her by the owner of such premises or by other
authorized person. A license or privilege to enter or remain in a
building which is only partly open to the public is not a license
or privilege to enter or remain in that part of the building which
is not open to the public.
TO TAMPER
To interfere with something improperly, to meddle with it,
displace it, make unwarranted alterations in its existing condition,
or to deprive, temporarily, the owner or possessor of that thing.
UTILITY
An enterprise which provides gas, electric, steam, water,
sewage disposal, or communication, video, internet, or voice over
internet protocol services, and any common carrier. It may be either
publicly or privately owned or operated.

A person shall not, without proper authorization from the fire
official in charge of said Fire Department emergency equipment, cling
to, attach oneself to, climb upon or into, board or swing upon any
Fire Department emergency vehicle, whether the same is in motion or
at rest; or sound the siren, horn bell or other sound-producing device
thereon; or manipulate, remove or tamper with or attempt to manipulate,
remove or tamper with any levers, valves, switches, starting devices,
brakes, pumps or any equipment or protective clothing on, or a part
of, any Fire Department emergency vehicle.

It shall be unlawful for any person to damage or deface or attempt
to damage or deface any Fire Department emergency vehicle at any time
or to injure or attempt to injure Fire Department personnel while
performing departmental duties.

A. Clearance Around Fire Hydrants And Other Equipment.
1. Posts, fences, vehicles, growth, trash, storage and other materials
or objects shall not be placed or kept near hydrants, fire department
inlet connections or fire protection system control valves in a manner
that would prevent such equipment or fire hydrants from being immediately
discernible. The Fire Department shall not be deterred or hindered
from gaining immediate access to fire protection equipment or fire
hydrants.
2. A four (4) foot clear space shall be maintained around the circumference
of fire hydrants except as otherwise required or approved. A height
of ten (10) feet from the ground shall be maintained.
3. If, upon the expiration of the time mentioned in a notice of violation,
obstructions or encroachments are not removed, the Fire Prevention
Code Official shall proceed to remove the same. Cost incurred in the
performance of necessary work shall be paid from the Municipal Treasury
on certificate of the Fire Prevention Code Official and with the approval
of the City Manager; and the legal authority of the municipality shall
institute appropriate action for the recovery of such costs.
B. Guard Posts. When a guard post is utilized to protect fire
hydrants or fire protection equipment, guard posts shall comply with
all the following requirements:
1. Constructed of steel not less than four (4) inches (102 mm) in diameter
and concrete filled.
2. Spaced not more than four (4) feet (1219 mm) between posts on center.
3. Set not less than three (3) feet (914 mm) deep in a concrete footing
of not less than fifteen (15) inch (381 mm) diameter.
4. Set with the top of the posts not less than three (3) feet (914 mm)
above ground.
5. Located not less than four (4) feet (914 mm) from the protected object.
C. Other Physical Barriers. Other physical barriers used to
protect hydrants or other fire protection equipment shall comply with
the following:
1. Top of barrier not higher than three (3) feet (914 mm) above the
ground.
2. Barrier will resist a force of twelve thousand (12,000) pounds applied
three (3) feet (914) mm above the ground.
3. Barrier located not less than four (4) feet (1219 mm) from the protected
object.
4. Barriers shall not be closer than twenty-eight (28) inches to each
other.
D. Trees And Shrubbery. Trees and shrubbery shall be kept trimmed
by the property owner so that during any weather conditions the foliage
or branches shall not extend beyond the curb line unless there is
a clearance of at least twelve (12) feet at any point above the roadway.
Cost to repair apparatus because of damage done because of failure
to comply with ruling will be the responsibility of the property owner.
A person commits the offense of reckless burning or exploding
if he/she recklessly starts a fire or causes an explosion and thereby
damages or destroys the property of another.
