As used in this Chapter, the following terms shall have the meanings indicated:
LOCAL AREA OF THE CITY OF ST. JAMES
That area contiguous with the City limits for a distance of three (3) miles.
MOBILE FOOD VEHICLE
A motorized or towed vehicle (sometimes referred to as a "food truck") which may temporarily park in an area designated by this Article and engaged in the service, sale or distribution of ready-to-eat food for individual portion service to the general public directly from the vehicle upon issuance of a license by the City Clerk and conformance with the regulations established by this Article.

MOBILE FOOD VEHICLE VENDOR
The registered owner of a mobile food vehicle or the owner's agent or employee and referred to in this Article as "vendor."

A. 
Local Area Persons. Any person, group of persons or organization residing or operating in the local area of the City of St. James desiring to solicit within the City of St. James for contributions of money and/or other recompense shall give notice to so solicit to the Chief of Police of the City of St. James ten (10) days prior to the intended date of soliciting. Said notice shall set forth the date(s) of solicitation, the name, address and telephone number of some local person from whom information may be obtained concerning the purpose of the contribution being sought, the name(s) of person(s) in charge of such group or organization, and the name(s) of person(s) who will be conducting the solicitation.
B. 
Non-Local Area Persons. Any individual, groups of individuals or organizations not residing or operating in the local area of the City of St. James shall give at least fourteen (14) days' notice to the Chief of Police of the City of St. James for contributions of money and/or other recompense. Said notice shall set forth the date(s) of solicitation, the name(s) of person(s) (including birth dates and social security numbers) who will be doing the soliciting, and shall furnish at least two (2) letters of reference from persons not associated with the organization or group of individuals verifying the purpose for which the funds to be solicited are to be used.

Any such solicitors not residing or operating within the local area of the City of St. James shall obtain a solicitors license from the Clerk of the City of St. James; said solicitors license shall be in effect for a period of two (2) days. The license fee shall be in the amount of fifteen dollars ($15.00) per person.

A. 
It shall be unlawful for any person, group of persons, or organization to solicit for contributions of money and/or other recompense at the following locations within the City of St. James:
1. 
Within a one-hundred-yard radius of the intersection of Jefferson Street and James Boulevard.

Any person soliciting contributions of money who exchanges goods, merchandise or products in return for the contribution shall first obtain a transient merchants license from the City of St. James. The license fee for transient merchants license shall be in the amount of thirty-five dollars ($35.00) per organization. (See Section 605.030.)

A. 
Hereafter, it shall be unlawful for any person engaging in or carrying on the business or occupation of a peddler or itinerant merchant within the City of St. James, Missouri, to park the vehicle from which he/she is operating his/her business upon the public streets, alleys, or other public parks or places within the City of St. James, Missouri; provided, however, that this provision shall not be construed to mean that such vehicle cannot be driven from place to place and temporarily stopped while the person operating the same is making or attempting to make a sale.
B. 
It is the intention of the City Council of the City of St. James, Missouri, to prohibit anyone engaging in or carrying on the business or occupation of a peddler or itinerant merchant to carry on such business at one (1) location by parking the operator's vehicle in any one (1) particular place during the time that he/she is carrying on his/her business as a peddler or itinerant merchant.
C. 
Any person violating this Chapter shall have his/her license revoked and shall be deemed guilty of an offense. (For penalty, see Section 100.220.)

A. 
It shall be unlawful for any person or entity (excluding, any religious, charitable or non-profit organization) to operate a mobile food vehicle within the City of St. James without having obtained a license for such purpose from the City Clerk.
B. 
Any persons engaged in the service, sale or distribution of ready-to-eat food for individual portion service to the general public directly from a vehicle food truck shall obtain a license from the City of St. James in the amount of one hundred dollars ($100.00).
C. 
Any person or entity desiring to operate a mobile food vehicle shall make a written application for such license to the City Clerk. The application for a license shall be on forms provided by the City of St. James and shall include, in addition to the information prescribed by the City Clerk the following:
1. 
The name, signature, phone number, email address, home address and business address of the applicant, and the name and address of the owner if the applicant is not the owner of the business.
2. 
A description and photograph of the mobile food vehicle to be used, including the license plate and registration number and vehicle identification number (V.I.N number), year, make and model of the vehicle.
3. 
Proof of an insurance policy, in the amount of fifty thousand dollars/one hundred thousand dollars/ten thousand dollars ($50,000.00/$100,000.00/$10,000.00) issued by an insurance company licensed to do business in the State, covering all claims for damages to property and bodily injury, including death, which may arise from operation under or in connection with the license or permit. Such insurance shall name the City as an additional insured and shall provide that the policy shall not terminate or be canceled prior to the expiration date without thirty (30) days’ advance written notice to the City.
4. 
A copy of the certification from the County Health Department for the business address where the mobile food vehicle is registered.
D. 
A license tax is hereby levied upon mobile food vehicles vendors for each separate mobile food vehicle pursuant to this Article. The fee for the license required and imposed under this Article shall be a minimum sum of one hundred dollars ($100.00). All vendors receiving a license under this Article shall pay said license fee annually.
E. 
A separate license shall be obtained for each vehicle used by the mobile food vehicle vendor if not the tow vehicle.
F. 
A special events permit may be issued for limited use during festivals and street fairs as directed by the City Council.

A. 
No operator of a mobile food vehicle shall park, stand or move a vehicle and conduct business within areas of the City of St. James where the license holder has not been authorized to operate.
B. 
All mobile food vehicle vendors shall provide a waste container for public use which the vendor shall empty at its own expense. All trash and garbage originating from the operation of the mobile food vehicles shall be collected and disposed of off-site by the operators at least each day and as often as is reasonable to protect the public health, safety and welfare. Spills of food or food by-products shall be cleaned up, and no dumping of gray water within the City shall be permitted.
C. 
No mobile food vehicle shall make or cause to be made any public nuisance.
D. 
Signage is only allowed when placed on mobile food vehicles. Separate freestanding signs are limited to no more than four (4) feet in height and three (3) feet in width and no more than two (2) per food truck are permitted.
E. 
No flashing or blinking lights, or strobe lights are allowed on a mobile food vehicles or related signage when the vehicle is parked and engaged in serving customers.
F. 
Mobile food vehicles shall be parked at the Tourist Information Center parking lot only unless the vendor has written permission to operate on private property from the affected property owner. The written permission must be turned in with the business license application. A private property owner shall not permit parking by a mobile food vehicle until a mobile food vehicle license has been granted by the City.
G. 
Mobile food vehicles shall not in any way restrict or interfere with the ingress or egress of the abutting property owner or tenant or otherwise hinder the lawful parking or operation of other vehicles.
H. 
A vendor shall not operate a mobile food vehicle within five hundred (500) feet of any fair, festival or special event or civic event that has been approved by the City of St. James unless the vendor has been approved as part of the event and issued a special event permit authorizing him or her to operate.
I. 
Any power or fuel required for the mobile food vehicle shall be self-contained, and a mobile food vehicle shall not use utilities drawn from the public right-of-way unless special arrangements have been made with the City Clerk and the St. James Utility Department first. Mobile food vehicles on private property may use electrical power from the property being occupied or an adjacent property, but only when the property owner provides written consent to do so. All power sources must be self-contained. No power cable or equipment shall be extended at or across any City street, alley or sidewalk.
J. 
Mobile food vehicles shall not operate within:
1. 
Fifteen (15) feet of any entranceway to any building;
2. 
Fifteen (15) feet of any driveway entrance;
3. 
One hundred (100) feet of a crosswalk or intersection;
4. 
Two hundred fifty (250) feet of an existing restaurant building during the hours when such restaurant is open for business or unless during a special event.
K. 
The issuance of a mobile food vehicle license does not grant or entitle the vendor to the exclusive use of any street or parking space.

A. 
Any person operating a mobile food vehicle in violation of any provision of Sections 610.070 through 610.090 of this Chapter shall be subject to all other enforcement provisions of Sections 610.070 through 610.090 of this Chapter.
B. 
Any license issued under Sections 610.070 through 610.090 of this Chapter may be revoked, suspended, or not renewed by the City Clerk for failure to comply with the provisions of Sections 610.070 through 610.090 of this Chapter and any rules or regulations promulgated by the City of St. James.
