The Board of Supervisors of the Township hereby approves entering into the 2011 Intergovernmental Cooperation Agreement for Funding and Utilization of Firefighting Personnel and Equipment (herein "agreement") between Union Township and the Borough of Birdsboro in accordance with the authorization under the Pennsylvania Intergovernmental Cooperation Act,[1] and the Second Class Township Code,[2] with a copy of the agreement attached hereto as Exhibit A and incorporated herein by reference.[3]

The purpose of the agreement shall be to allow the participating municipalities to cooperate in the joint funding and utilization of firefighting personnel and equipment across the boundaries of their respective municipalities, including the funding and utilization of the Birdsboro Union Fire Department, and its supporting relief association, the Birdsboro Union Relief Association.
The Chairman of the Board of Supervisors of the Township, or any other Supervisor so designated by the Board of Supervisors, is hereby authorized and directed on behalf of the Township to execute and deliver the agreement; execute and deliver such additional documents and take such further actions as may be necessary to implement the agreement and facilitate the funding and the transactions contemplated under the agreement.
All actions of the Supervisors, and any officer, agent or other representative of the Township, taken in furtherance of the joint funding and utilization of firefighting personnel and equipment prior to the execution of the agreement are hereby ratified, authorized and approved in all respects.
As required under the Pennsylvania Intergovernmental Cooperation Act, the following matters are specifically found and determined:
A. 
The conditions of the agreement are as set forth in the agreement;
B. 
This agreement shall continue in effect until terminated by a subsequent ordinance of the governing body of any participating municipalities. A participating municipality may withdraw from this agreement by providing written notice to the remaining municipality no less than 90 days prior to the end of the then-current calendar year. No termination will be permitted, except at the end of the calendar year, to protect funding under the annual budgets set by both municipalities;
C. 
The purpose and objectives of the agreement are as set forth in the background of this article and of the agreement;
D. 
The manner and extent of financing the agreement shall be as follows:
(1) 
No borrowing will be required by the Township to fund its obligations under the agreement;
(2) 
Funds to implement the Township's obligations under the agreement shall come from usual budgeted amounts for firefighting personnel and equipment; and
(3) 
Other provisions governing the manner and extent of the cooperative funding and utilization of firefighting personnel and equipment, as well as provisions relating to the expenditure of funds, shall be as set forth in the agreement, with the provision that the agreement may be modified from time to time as shall be necessary, without the need of amending the Code of Union Township. Such amendments shall be adopted by resolution as addendums to the cooperative agreement.
E. 
All personal property shall be acquired, managed and disposed of in accordance with the terms of the agreement;
F. 
The organization and administration of the agreement shall be undertaken in accordance with the terms of the agreement.
