The Borough Manager, or his designee, is hereby directed to
notify the County Assessor's office or other authority responsible
for the assessment of property in the Borough of the construction
of a building or buildings not otherwise exempt from tax in the Borough
for the purposes of having said building and the property where it
is situate reassessed.
Upon reassessment, any said property shall be added to or revised
on the tax duplicate and shall be taxable for Borough purposes for
the proportionate part of the fiscal year remaining after the property
was so improved by reason of the construction of the building. The
entire improvement of new construction shall generally be measured
at and from the time of occupancy, and occupancy occurring during
a month shall be treated as occurring on the first day of the following
month.
A certified list of additions and revisions will be furnished
by Allegheny County to the Collector for collection.

As used in this article, the following terms shall have the
meanings indicated:
The Borough of Fox Chapel.
Any offense punishable under Pa.C.S.A. Title 18 or 75.
Any person duly employed by the Borough of Fox Chapel, including,
but not limited to, a police officer who is by law given the power
to arrest when acting within the scope of the person's employment.
The term "employee" also includes a person who is considered to be
an employee of the Borough as set forth in the Workers' Compensation
Act at 77 P.S. § 1031.
Includes any pooled or collective trust.
Any person who causes personal injury to the person or property
of any other as a direct result of a crime.
Actual bodily harm directly resulting from the crime.
Any person, except an offender, who suffered injuries to
his person or property as a direct result of a crime. The term "victim"
specifically includes the Borough of Fox Chapel and any insurance
company that has compensated the victim for loss under an insurance
agreement.
When required as a condition of probation or parole, offenders
convicted of a crime wherein an employee suffered injury to property
or personal injury directly resulting from the crime shall make restitution
in the amount of the value of the loss sustained by the victim, the
Borough or an insurance company, as ordered by the sentencing court.

Request
for information of loss. When a Borough employee who has suffered
personal injury receives notification from the District Attorney's
office of a pending trial for the offender, the employee who suffered
personal injury shall request the Borough Manager to provide to the
employee the monetary value of the loss sustained by the Borough and
the Borough's insurance company.

Reporting.
If the offender is convicted of a crime which resulted in personal
injury to the employee, the employee shall inform the Assistant District
Attorney prior to sentencing of the loss sustained by the employee,
the Borough and the Borough's insurance company so that restitution
may be ordered by the court pursuant to 18 Pa.C.S.A. § 1106(c).

Preservation
of private remedies. No judgment or order of restitution shall debar
the Borough, the Borough's insurance company or any employee
who sustained personal injury, by appropriate action, to recover from
the offender as otherwise provided by law, provided that any civil
award shall be reduced by the amount paid under this article to the
particular party.

Notification
of value of Borough loss. Upon request from a Borough employee who
has suffered personal injury directly resulting from a crime, the
Borough Manager shall provide to the requesting employee the monetary
value of the loss sustained by the Borough and the Borough's
insurance company.
B.Â
Value
of loss. Value of Borough loss shall include, but not be limited to,
medical expenses, amount of medical expenses not covered by the Borough
insurance company, amount of compensation received by the employee
during absence from duty caused by the offender, and the amount of
compensation paid to the employee not reimbursed by the insurance
company of the Borough, as a direct result of the offender's
crime.
