A. 
Whenever any environmental disturbance is undertaken or initiated within the Borough of Fox Chapel without the prior approval of Council as required by this part, or whenever a disturbance has been approved subject to certain limitations, conditions or restrictions imposed by Council in accordance with this part and such limitations, conditions or restrictions are not being complied with, the Code Enforcement Officer may institute in the name of the Borough of Fox Chapel any appropriate judicial action or proceedings to restrain, enjoin, correct or abate such unlawful activity.
B. 
For each and every violation of the provisions of this part, any person, whether as an individual, principal, agent, employer or employee of another, upon conviction thereof, shall be punishable by a fine of not more than $1,000 plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the Allegheny County correctional facility for a period not exceeding 30 days.[1]

C. 
Each violation of the provisions of this part shall constitute a separate offense, and each day that a violation continues shall be considered a separate offense, punishable by the like fine or penalty.
D. 
Written notice of a violation of this part shall not be a prerequisite to conviction for such violation of this part.
E. 
The fines and penalties provided for by this section may be collected by suit or summary proceeding brought in the name of the Borough of Fox Chapel before any Magisterial District Judge or other court of competent jurisdiction.
F. 
The rights and remedies provided for by this part are cumulative and are in addition to all other remedies provided by law.
The collection of any penalty under the provisions of this part shall not be construed as stopping the Borough from proceeding in courts of law or equity to abate, restrain or enjoin conduct forbidden under this part or to abate nuisances under existing law. It is hereby declared to be the purpose of this part to provide additional and cumulative remedies, and nothing in this part shall in any way abridge or alter rights of action or remedies now or hereafter existing in equity or under the common law or statutory law.
