The Dutchess County Legislature hereby determines that the need exists for the establishment of an Industrial and Commercial Incentive Board pursuant to § 485-b of the Real Property Tax Law of the State of New York, as amended.
The Dutchess County Legislature does hereby establish an Industrial and Commercial Incentive Board pursuant to § 485-b of the Real Property Tax Law of the State of New York, as amended.
A. 
The Industrial and Commercial Incentive Board shall review the various types of business real property in the County, the applicability of exemptions, the percentage of exemptions, and geographic areas for exemptions, and shall present a plan to the County Legislature concerning the various types of business real property which should be granted eligibility for an exemption pursuant to Subdivision 1 of § 485-b of the Real Property Tax Law. Such plan shall be accompanied by a proposed local law providing for its implementation.
B. 
Such plan shall make a recommendation as to whether the exemption shall be computed as provided in Subdivision 2 or 12 of § 485-b of the Real Property Tax Law.
C. 
Such plan shall make recommendations concerning the applicability of the exemption to specific sectors and subsectors, as defined in the North American Industry Classification System published by the United States Government.[1]

D. 
Such plan shall identify specific geographic areas within which such exemptions shall be offered.
E. 
In developing the plan required by this article, the Board shall consider the planning objectives of each municipality within which such exemptions may be offered, the necessity of the exemption to attraction or retention of such business and the economic benefit to the area of providing exemptions to various types of businesses.
F. 
The Board may make recommendations to the County Legislature with respect to actions it deems desirable to improve the economic climate of the County.
G. 
The Board, upon completion and submission of its initial plan, shall continue to review economic conditions in the County and the applicability of § 485-b exemptions and shall, from time to time, submit plans with recommendations to the Dutchess County Legislature.
A. 
The members of the Industrial and Commercial Incentive Board hereby created shall be appointed as follows:
(1) 
Three representatives of the County, one of whom shall be appointed by the County Executive, who shall serve as the Chair; one shall be appointed by the majority party of the County legislative body, and one shall be appointed by the minority party of the County legislative body.
(2) 
Each city shall be represented by one member recommended and named by the Mayor and confirmed by its Council.
(3) 
Each town shall be represented by one member recommended and named by the Supervisor and confirmed by the Town Board.
(4) 
One member shall be appointed to collectively represent all of the villages within the County, being recommended and named by all the Mayors of the villages.
(5) 
One member shall be appointed to collectively represent all of the school districts located within the County, recommended and named by the County School Board Association.
B. 
All such members of the Board shall serve at the pleasure of the respective governing body or appointing authority which they represent.
C. 
The members of the Board shall serve without salary, but the County Legislature may entitle reimbursement for actual and necessary expenses incurred in the performance of their duties.
