E911 system — See Ch. 147.
The Dutchess County Legislature hereby determines that in order for the E-911 system to operate efficiently, the system should not receive automatically dialed telephone calls reporting fire, intrusion or medical alert activations. The County has established a dedicated ten-digit telephone line to accept such fire, intrusion and medical alerts.
As used in this chapter, the following terms shall have the meanings indicated:
ALARM DEVICE
Any type of alarm system activating equipment that provides a warning of intrusion, break-in, movement, medical emergency, fire or smoke. When activated, said alarm produces an audio or visual signal which may be connected to the telephone lines of an alarm company, monitoring service or which may be heard or seen by the general public. This chapter shall not apply to an alarm installed in a motor vehicle, water vessel, aircraft, or which is a battery-operated single-station smoke detection device.
DIRECT-DIAL SERVICE
An alarm device which is connected to a telephone line and upon activation of an alarm device automatically dials a predetermined telephone number and transmits a message or a signal indicating the need for emergency response by an ambulance, fire department or law enforcement agency.
PERSON
Any individual, firm, company, partnership or corporation.
A. 
It shall be a violation of this chapter for any automatic telephone direct-dial service device to be connected to the emergency telephone lines of any E-911 public safety answering point (PSAP) within the County of Dutchess.
B. 
It shall be a violation of this chapter for any alarm installation or monitoring company to report an alarm activation by dialing 9-1-1 within the County of Dutchess.
C. 
A dedicated ten-digit telephone number will be assigned by each E-911 PSAP and local police agency to receive reports of alarm activations. The list of the ten-digit telephone numbers may be obtained from the Dutchess County Department of Emergency Response.
D. 
Any violation of this section will result in the issuance of a notice of violation to the alarm installer, conviction of which shall result in a fine of $50 per incident, in addition to any other fines which may be imposed pursuant to this chapter.
A. 
All fines imposed under this chapter shall be payable to the County of Dutchess in care of the Department of Emergency Response offices.
B. 
Any fines provided for by this chapter shall be subject to periodic modification by resolution of the County Legislature.
The Dutchess County Attorney's Office may commence a proceeding in any court of competent jurisdiction for the amount of any fines assessed herein. If any judgment is not paid within 30 days of issuance, said judgment shall be filed with the Dutchess County Clerk's Office and same shall be a lien against the real property.
