It shall be unlawful for any person, copartnership, firm or corporation to remove, dig up, mutilate, injure or otherwise damage or destroy any flowers, plants, leaf mold or topsoil upon any private property or along any of the streets or alleys in the Borough without the permission of the owner first had and obtained.

Any person, partnership or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay not more than $1,000 and costs of prosecution or, in default of payment of said fine and costs, to undergo imprisonment for not more than 30 days.

It is hereby declared that:
A. 
The protection and preservation of the home is the keystone of democratic government;
B. 
The public safety, health and welfare and the good order of the Borough of Fox Chapel require that members of the community enjoy a feeling of well-being, security, tranquility and privacy, both in and while they are away from their homes and dwellings;
C. 
The practice of picketing before or about residences and dwellings causes emotional disturbance and distress to the occupants of said residences and dwellings;
D. 
Such practice also obstructs and interferes with the free use of public sidewalks and public ways of travel;
E. 
Such practice has as its object the harassing of such occupants;
F. 
Without resort to such practice, full opportunity exists and, under the terms and provisions of this article, will continue to exist for the exercise of freedom of speech and other constitutional rights; and
G. 
The provisions are necessary for public interest to avoid the detrimental results herein set forth and are enacted by the Council of the Borough of Fox Chapel pursuant to the provisions of the Borough Code at 8 Pa.C.S.A. § 1202(12) and (14).
It is unlawful for any person to engage in picketing before or about the residence or dwelling of any individual in the Borough of Fox Chapel.
Any person violating the provisions of this article shall, upon conviction, be fined not more than $1,000 together with the costs of prosecution and, in default of payment of such forfeiture and costs of prosecution, shall be imprisoned until such forfeiture and costs are paid, but not to exceed 30 days. Each violation of this article and each day the same is continued shall constitute a separate violation hereof.
