The following procedure shall apply to disposal of a surplus
tangible supply with an estimated net value of less than $10,000.
A.
A procurement
officer of the Town or of a Town department, board, committee or other
Town agency shall dispose of a surplus tangible supply with an estimated
net value of less than $10,000 by offering such supply for purchase
at public auction.
B.
A procurement
officer who proceeds with a public auction shall give public notice
of the auction. The notice shall describe the supply offered for sale
and the terms and conditions of the sale, including the place, date
and time for the auction, The notice shall state that the governmental
body retains the right to reject any and all bids. The notice shall
be published at least once, not less than 10 days prior to the time
of the auction, in a newspaper of general circulation in the Town.
C.
If there
is an established market for a surplus tangible supply, a procurement
officer, instead of offering the supply at public auction, may offer
the supply for purchase to at least three parties who are regular
participants in such market.
As used in this bylaw, the following terms shall have the meanings
indicated:
Shall have the meaning set forth in MGL c. 30B, § 2
for "procurement officer."
Tangible personal property determined by a Town department,
board, committee or other agency having possession and control of
the property to be no longer useful but having resale or salvage value.
This procedure is intended to be a written procedure for disposal
of supply with an estimated net value of less than $10,000 required
pursuant to MGL c. 30B, § 15(f).
