Pursuant to Section 11 of the Uniform Fire Safety Act, N.J.S.A. 52:27D-192 et seq., the New Jersey Uniform Fire Code, N.J.A.C. 5:70-1 et seq., shall be locally enforced in the Township of Greenwich.

The local enforcing agency shall be the Stewartsville Volunteer Fire Company through its Bureau of Fire Prevention which is hereby created therein. The Bureau of Fire Prevention shall hereinafter be known and designated as the local enforcing agency.

The local enforcing agency shall enforce the New Jersey Uniform Fire Code in all buildings, structures and premises within the established boundaries of the Township of Greenwich other than one- and two-unit owner-occupied dwellings used exclusively for dwelling purposes, with the exception of the inspection for and issuance of the certificate of smoke detector compliance as provided herein, and buildings, structures, and premises owned or operated by the federal government, interstate agencies or the State of New Jersey.

The local enforcing agency shall faithfully comply with all applicable requirements of the Uniform Fire Safety Act and the New Jersey Uniform Fire Code.

The Bureau of Fire Prevention established by ยงย 3A-2 of this chapter shall be under the direct supervision and control of a Fire Official who shall report to the Chief of the Stewartsville Volunteer Fire Company.

The Bureau of Fire Prevention shall have at least one paid inspector.

The Fire Official shall be certified by the State of New Jersey and appointed by the Township Committee of the Township of Greenwich. The Chief of the Stewartsville Volunteer Fire Company shall submit for nomination a list of three names to the Township Committee for such appointment.

Inspectors and other employees of the enforcing agency shall be appointed by the Township Committee of the Township of Greenwich. The Chief of the Stewartsville Volunteer Fire Company shall recommend the names of such inspectors and other employees for such appointment. All life hazard use inspectors shall be certified by the State of New Jersey.

The Fire Official shall serve for a term of three years. Any vacancy shall be filled for the unexpired term.

The Bureau of Fire Prevention established by ยงย 3A-2 of this chapter shall carry out the registration and periodic inspections life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs.

The annual registration fees for life-hazard uses shall be in accordance with the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1 et seq.).

In addition to the registrations required by the Uniform Fire Code, the following non-life-hazard uses shall register with the Bureau of Fire Prevention. These uses shall be inspected once per year and shall pay an annual fee as set forth below:

R-a uses shall only be inspected upon sale or change of tenant.

Use groups are defined in the Uniform Construction Code (N.J.A.C. 5:23-1.1 et seq.). Uses not classified above will be classified as business uses.

Uses required to register with the State of New Jersey as life hazard uses shall not be required to register with this section.

In the discretion of the Fire Official, vacant buildings will be charged and inspected according to the previous use of the building.

The Bureau of Fire Prevention shall be responsible for the issuance of every certificate of smoke detector compliance for the sale, lease or change of occupancy of every residential structure within the Township of Greenwich.

Before any Use Group R-3 structure is sold, leased or otherwise made subject to a change of occupancy for residential purposes, the owner of such structure shall obtain a certificate of smoke detector compliance from the Bureau of Fire Prevention evidencing compliance with the requirements of the New Jersey Uniform Fire Code for the location and operation of smoke detectors within such structure.

The fee for the application for a certificate of smoke detector compliance for a Use Group R-3 structure shall be $25 per structure.

Enforcement, violations and penalties shall be managed in conformity with the Uniform Fire Safety Act, the New Jersey Uniform Fire Code and otherwise in accordance with the laws of the State of New Jersey.

In accordance with Sections 15 and 17 (N.J.S.A. 52:27D-206 and 52:27D-208) of the Uniform Fire Safety Act, any person aggrieved by any action of the local enforcing agency shall have the right to appeal to the Construction Board of Appeals of Warren County.

All properties within the Township of Greenwich having an automatic fire alarm system or a fire sprinkler system shall be equipped with a key box. Residential property shall be exempt from this requirement.

The key box shall be of UL-type and approved by the Greenwich Township Building Inspector or Fire Official. The key box shall be installed in a location approved by the Greenwich Township Building Inspector or Fire Official.

The key boxes shall contain the following.
a.ย 
Keys to locked points of egress, whether on the interior or exterior of such buildings.
b.ย 
Keys to locked mechanical equipment rooms.
c.ย 
Keys to locked electrical rooms.
d.ย 
Keys to elevator controls.
e.ย 
Keys to other areas as directed by the Township Building Inspector or Fire Official.

All existing buildings shall comply within 12 months of the effective date of this section. All newly constructed buildings, not yet occupied, or buildings currently under construction shall comply immediately.

Any building owner violating this section after notice from the Greenwich Township Building Inspector or Fire Official shall be subject to a fine of $100.

This section regarding firesafety and establishing requirements for fire hydrants (this "section") shall be applicable to any and all proposed plans or designs for new construction, including, but not limited to, residential and commercial construction as well as the construction, expansion and/or replacement of water mains or other such public water supplies, within Greenwich Township ("new construction").

Any and all plans or designs for new construction shall incorporate, include and support the installation of fire hydrants for purposes of fire prevention and firesafety, as set forth herein.

All fire hydrants within Greenwich Township (the "Township") shall have:
a.ย 
A total of three outlets, as follows: two two-and-one-half-inch National Standard male-thread outlets and one four-and-one-half-inch National Standard male-thread outlet with a five-inch Storz connection and lock tab and cap; and
b.ย 
Hydrant anchoring tee; and
c.ย 
Six-inch gate valve; and
d.ย 
Ductile-iron pipe, Class 52, six inches in diameter and length.

The number of fire hydrants associated with any new construction, placement of fire hydrants and required water flow for each fire hydrant shall be calculated in accordance with the most-current edition of the National Fire Protection Association's NFPA 1142: Standard on Water Supplies for Suburban and Rural Fire Fighting.

All new fire hydrants shall be placed and installed:
1.ย 
Two feet behind the face of the curb of the roadway, except that if there is no curb, then three feet from the edge of the roadway pavement; and
2.ย 
As close to the side property lines as feasible; and
3.ย 
If at an intersection, then either before or after the corner radius.
b.ย 
However, in no event shall the distance between any two fire hydrants within the Township exceed 1,000 feet.

The Fire Chief of the Stewartsville Volunteer Fire Company, or a representative so designated by the Fire Chief of the Stewartsville Volunteer Fire Company, shall be the authority having jurisdiction ("AHJ") over the implementation and enforcement of this section.

The proposed location of any fire hydrant ("location proposal") within the Township shall be submitted, in writing, to the AHJ for review and approval. The AHJ shall either approve or deny the location proposal in writing. A copy of any approval issued by the AHJ, together with the location proposal, shall also be provided to the water purveyor that is responsible for the allocation and distribution of water to the Township.

Written notice of any maintenance, repair or replacement of any fire hydrant within the Township shall be provided to the AHJ at least seven days in advance of the commencement of said maintenance, repair or replacement ("work"). Said notice shall identify the specific fire hydrant at issue and the date that the work is scheduled to commence. Upon completion of the work, the AHJ shall be notified accordingly, and the AHJ shall thereafter inspect the fire hydrant at issue.

All fire hydrants within the Township shall be tested at least once per year. The Township shall be responsible for the testing and maintenance of all fire hydrants located within a right-of-way of the public streets within the Township. Fire hydrants that are owned by private parties shall be tested and maintained in accordance with this section at no cost to the Township.

If any section, paragraph, subdivision, clause or provision of this section shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged, and the remainder of this section shall be deemed valid and effective.
