It shall be unlawful for any person to cause or permit effluent from any septic tank, aerobic tank, holding tank, or any other subsurface sewage disposal system to be discharged upon the surface of the ground on any public or private property in the Township of Carroll, or into any stream, lake, pond or other body of water. This prohibition shall not apply to any discharge made pursuant to and in accordance with any order, license or permit issued by or at the direction of the Pennsylvania Department of Environmental Protection.
A. 
Any person who shall violate any of the provisions of this article shall be guilty of a summary offense, and upon conviction thereof, shall be subject to a fine or penalty of not less than $10 nor more than $300 for each and every offense. Upon judgment against any person being entered and upon default in the payment of the fine and costs, the defendant may be sentenced and committed to the York County Prison for a period not to exceed 30 days for each such offense.
B. 
Any violation of this article which shall continue after conviction for said violation, shall be deemed to be a separate offense for each day that said violation continues in the absence of a good faith effort to abate the violation.
In addition to any other remedies provided in this article, any violation of this article shall constitute a public nuisance and the Supervisors of Carroll Township are authorized personally or by their agents to enter upon any public or private property in the Township and to abate said violation if the owner of the premises fails to do so after 10 days' notice in writing and impose the cost of such abatement upon the owner of the premises in the manner provided by the terms of the Act of May 1, 1933, P.L. 103, Art. VII, § 702, cl.XII, 53 P.S. § 66529, as amended.
In addition to any other remedies provided in this article, the Supervisors of Carroll Township are authorized to abate any violation of this article by seeking legal or equitable relief from any court of competent jurisdiction.
This article is enacted pursuant to the authority contained in the Act of May 1, 1933, P.L. 103, Art. VII, § 702, cl.XII, as amended, 53 P.S. § 66529 and the Act of May 1, 1933, P.L. 103, Art. VII, § 702, cl.XXV, as amended, 53 P.S. § 66601.
